Conclusion<br />

These 2 Conv<strong>in</strong>c<strong>in</strong>g Ground case studies provide powerful examples of<br />

how the council is alleged to have failed to protect, through the<br />

establishment of appropriate <strong>plann<strong>in</strong>g</strong> controls and adm<strong>in</strong>istration of the<br />

<strong>plann<strong>in</strong>g</strong> scheme, an area of historical and Aborig<strong>in</strong>al significance. This is<br />

despite receiv<strong>in</strong>g clear advice from AAV (<strong>in</strong> 2001) that the Conv<strong>in</strong>c<strong>in</strong>g<br />

Ground was registered as an Aborig<strong>in</strong>al place and protected under the<br />

Aborig<strong>in</strong>al and Torres Strait Islander Heritage Protection Act 1984. <strong>Council</strong>’s<br />

alleged failures will be exam<strong>in</strong>ed through a number of applications to<br />

VCAT which are to be heard <strong>in</strong> December <strong>2005</strong>.<br />

Recommendations<br />

5. That the council, work with local Aborig<strong>in</strong>al communities and<br />

AAV to:<br />

identify significant Aborig<strong>in</strong>al sites<br />

(through the <strong>plann<strong>in</strong>g</strong> scheme) establish controls to prevent<br />

these sites from <strong>in</strong>appropriate development.<br />

6. Until such time as significant Aborig<strong>in</strong>al sites are identified and<br />

specific controls established to protect them, the council comply<br />

with the requirements currently exist<strong>in</strong>g <strong>in</strong> the <strong>plann<strong>in</strong>g</strong><br />

scheme.<br />

Recommendations are agreed.<br />

The Memorandum of Understand<strong>in</strong>g between <strong>Glenelg</strong> <strong>Shire</strong> <strong>Council</strong> and the<br />

Indigenous Communities (f<strong>in</strong>al draft) <strong>in</strong>cludes a commitment to develop the<br />

means by which the <strong>plann<strong>in</strong>g</strong> processes of the <strong>Council</strong> identify and protect the<br />

shire’s cultural heritage value, <strong>in</strong> particular:<br />

the development and use of strong, <strong>in</strong>clusive, well def<strong>in</strong>ed policies<br />

support<strong>in</strong>g strong objectives of the Municipal Strategic Statement<br />

the development and use of a protocol which acts <strong>in</strong> addition to the<br />

<strong>plann<strong>in</strong>g</strong> process by requir<strong>in</strong>g <strong>in</strong>put and advice from local Indigenous<br />

groups and corporations<br />

the development of a heritage and cultural overlay over the <strong>Glenelg</strong> <strong>Shire</strong>.<br />

It should be noted that the first time the boundaries of the Conv<strong>in</strong>c<strong>in</strong>g Ground<br />

were identified was when a map of the Conv<strong>in</strong>c<strong>in</strong>g Ground was tabled at the<br />

mediation meet<strong>in</strong>g relat<strong>in</strong>g to this matter on 20 June <strong>2005</strong>.<br />

<strong>Council</strong> is now comply<strong>in</strong>g with the requirements currently exist<strong>in</strong>g <strong>in</strong> the<br />

<strong>plann<strong>in</strong>g</strong> scheme.
