3.5 Assessment of <strong>plann<strong>in</strong>g</strong> requirements<br />

3.5.1 Introduction<br />

Follow<strong>in</strong>g <strong>in</strong>itial appraisal, notification and referral comes the crucial<br />

assessment stage of the <strong>plann<strong>in</strong>g</strong> process.<br />

This section focuses on the follow<strong>in</strong>g 6 areas where our file review showed<br />

that compliance, consistency and possible adverse affects had not been<br />

adequately considered:<br />

heritage considerations<br />

Aborig<strong>in</strong>al cultural considerations<br />

environmental considerations<br />

rural subdivisions of land<br />

approval of permits without development plans<br />

amendments to approved <strong>plann<strong>in</strong>g</strong> permits.<br />

Before turn<strong>in</strong>g to these 6 areas though, we describe 2 key terms that recur<br />

throughout our discussion: zones and overlays.<br />

Zones and overlays<br />

The strategic policy, long-term directions and outcomes sought by the<br />

council are largely implemented through the zone, overlay and “particular<br />

provision requirements” of the <strong>plann<strong>in</strong>g</strong> scheme:<br />

Zones describe the land uses or developments allowed with<strong>in</strong> the area,<br />

such as residential, bus<strong>in</strong>ess, <strong>in</strong>dustrial or rural uses. They are used to<br />

<strong>in</strong>dicate whether the land use or development proposal requires a<br />

permit, and to <strong>in</strong>dicate the conditions apply<strong>in</strong>g to permits provided.<br />

All property with<strong>in</strong> the <strong>Glenelg</strong> <strong>Shire</strong> has been allocated a zone<br />

classification (4 public land, 3 residential, 3 <strong>in</strong>dustrial, 3 rural, 2 bus<strong>in</strong>ess<br />

and 2 special purpose zones).<br />

Zones also regulate subdivisions, build<strong>in</strong>gs and works.<br />

Overlays def<strong>in</strong>e specific characteristics such as land subject to flood<strong>in</strong>g,<br />

land with significant vegetation or heritage areas, and <strong>in</strong>corporate<br />

specific controls. Where overlays apply, they operate <strong>in</strong> addition to the<br />

zone requirements and generally concern environmental, landscape,<br />

heritage, built form, and land and site management issues.<br />

Several overlays can apply to the same piece of land.<br />

The overlays conta<strong>in</strong> a statement of objectives, permit requirements and<br />

exemptions, if appropriate. The purpose and decision guidel<strong>in</strong>es <strong>in</strong> the<br />

overlay must be taken <strong>in</strong>to account when the council makes a decision<br />

about a <strong>plann<strong>in</strong>g</strong> application.
