the DPC to conduct <strong>in</strong>formal mediation where an application can be<br />

presented and discussed <strong>in</strong> the presence of both objectors and the<br />

applicant. This is with a view to achiev<strong>in</strong>g negotiated settlements and the<br />

best <strong>plann<strong>in</strong>g</strong> outcomes<br />

the DPC to make a decision on the application or refer the matter to the<br />

council for decision.<br />

4.9.4 Conclusion<br />

The council has, <strong>in</strong> recent times, been proactive <strong>in</strong> address<strong>in</strong>g concerns with<br />

its <strong>plann<strong>in</strong>g</strong> function. New procedures, based on sound practice and statutory<br />

requirements, have ensured consistency <strong>in</strong> the council <strong>plann<strong>in</strong>g</strong> processes.<br />

These new procedures also m<strong>in</strong>imise the risk of <strong>in</strong>correct <strong>plann<strong>in</strong>g</strong> decisions<br />

be<strong>in</strong>g made, and challenges to decisions on the basis of <strong>in</strong>adequate<br />

assessment of material detriment and failure to notify <strong>in</strong>terested parties.<br />

Some councillors, developers and others regularly <strong>in</strong>volved <strong>in</strong> the <strong>plann<strong>in</strong>g</strong><br />

process have been critical of the changed processes, believ<strong>in</strong>g that <strong>plann<strong>in</strong>g</strong><br />

decisions may not be made as quickly as <strong>in</strong> the past. However, we consider<br />

that the <strong>in</strong>itiatives and changes put <strong>in</strong> place by the council have significantly<br />

improved the effectiveness, transparency and probity of its statutory<br />

<strong>plann<strong>in</strong>g</strong> service.<br />

It is important that the effectiveness of the council’s <strong>in</strong>itiatives be assessed<br />

after 12 months of operation. Further changes may be possible, such as<br />

relax<strong>in</strong>g the m<strong>in</strong>imum 5-day permit assessment process for rout<strong>in</strong>e<br />

applications. This will yield greater efficiencies <strong>in</strong> the council’s statutory<br />

<strong>plann<strong>in</strong>g</strong> process.<br />

Both <strong>in</strong> this audit and the council’s own <strong>in</strong>ternal review, the engagement of<br />

councillors <strong>in</strong> the <strong>plann<strong>in</strong>g</strong> function was identified as critical to better<br />

<strong>plann<strong>in</strong>g</strong> outcomes. To some extent, this has been achieved with the sett<strong>in</strong>g<br />

up of the DPC.<br />

The performance improvement plan developed as part of this audit<br />

(Appendix A of this report) could complement the council’s cont<strong>in</strong>uous<br />

improvement activity of this critical service delivery area.<br />

Recommendation<br />

17. That the council:<br />

review its recently <strong>in</strong>troduced <strong>in</strong>itiatives and provide a report<br />

to council members on the f<strong>in</strong>d<strong>in</strong>gs<br />

consider implement<strong>in</strong>g the <strong>plann<strong>in</strong>g</strong> process improvements<br />

outl<strong>in</strong>ed <strong>in</strong> the performance improvement plan attached to this<br />

report (Appendix A).
