Conclusion<br />

We are unable to say why areas were designated <strong>in</strong> the heritage overlay maps,<br />

but not <strong>in</strong>cluded <strong>in</strong> the schedule to the overlay. It seems likely these heritage<br />

areas were not <strong>in</strong>cluded <strong>in</strong> the schedule due to an adm<strong>in</strong>istrative oversight.<br />

We identified <strong>in</strong>stances where the council, through its <strong>in</strong>appropriate<br />

application of the heritage overlay requirements, failed to protect the<br />

shire’s heritage assets. Our view is consistent with VCAT’s 2001 decision.<br />

Failure to apply the heritage overlay controls is of particular concern<br />

where the zon<strong>in</strong>g of properties (for example, as Bus<strong>in</strong>ess Zone 1) removes<br />

the need to provide details of the proposal to owners and tenants of<br />

surround<strong>in</strong>g properties, mak<strong>in</strong>g the proposal exempt from the normal<br />

objection and appeal requirements of the Act.<br />

The absence of a heritage policy, a neighbourhood character overlay, and a<br />

design and development overlay for the Portland town centre has also<br />

impacted on the ability of the council to preserve its heritage assets.<br />

Recommendation<br />

4. That the council:<br />

before it approves an application to change the use or to<br />

develop land with<strong>in</strong> a designated heritage area, consider the<br />

potential impact of the proposal on the heritage values of the<br />

site and/or its sett<strong>in</strong>g and area. This is particularly so, where<br />

the zon<strong>in</strong>g of properties (such as <strong>in</strong> Bus<strong>in</strong>ess Zone 1) removes<br />

the need to provide details of any proposal to owners and<br />

tenants of properties surround<strong>in</strong>g the site, mak<strong>in</strong>g the<br />

proposal exempt from the normal objection and appeal<br />

requirements of the Plann<strong>in</strong>g and Environment Act 1987<br />

develops a heritage policy, and considers develop<strong>in</strong>g a<br />

neighbourhood character overlay, and a design and<br />

development overlay for the Portland town centre.<br />

Recommendation agreed.<br />

Pre application meet<strong>in</strong>gs are held with council’s heritage advisor and all<br />

applications <strong>in</strong> heritage overlay areas are referred to the advisor.<br />

<strong>Council</strong> has completed stage 1 of the Heritage Study and is currently<br />

undertak<strong>in</strong>g Stage 2. The heritage policy and design and development overlay<br />

are due for completion <strong>in</strong> October <strong>2005</strong>. <strong>Council</strong> has assessed the<br />

neighbourhood character overlay is of a lower priority at this stage.
