and Environmental Rural Zones, the council<br />

considers the specific requirements of the <strong>plann<strong>in</strong>g</strong> scheme<br />

takes account of the broader objectives of the scheme,<br />

consider<strong>in</strong>g the best use of the land for subdivision.<br />

The <strong>Glenelg</strong> <strong>Shire</strong> <strong>Council</strong> town <strong>plann<strong>in</strong>g</strong> department is proactive <strong>in</strong><br />

consider<strong>in</strong>g all requirements of the <strong>plann<strong>in</strong>g</strong> scheme. <strong>Council</strong> is prepar<strong>in</strong>g to<br />

undertake a Master <strong>Community</strong> Settlement Plan process to set vision,<br />

<strong>in</strong>clud<strong>in</strong>g future residential development.<br />

3.5.6 Approval of permits without a development plan<br />

Two overlays commonly used by councils to achieve coord<strong>in</strong>ated<br />

development of specific areas of land are the <strong>in</strong>corporated plan overlays<br />

(IPOs) and development plan overlays (DPOs). These overlays are used to<br />

implement plans that guide the future development of land <strong>in</strong> the area<br />

covered by the overlay.<br />

The plans outl<strong>in</strong>e the form and conditions that must be met before any<br />

changed land use and development is approved.<br />

In the case of a DPO a schedule to the overlay may allow a permit to be<br />

issued without a development plan hav<strong>in</strong>g been approved, but it must<br />

expressly allow this to occur. If it does not, no permit can be issued before<br />

a DPO is <strong>in</strong> place.<br />

Why have IPOs and DPOs?<br />

IPOs and DPOs do not set up permit requirements, but stop permits be<strong>in</strong>g<br />

granted <strong>in</strong> areas covered by the overlays, until the relevant plans are<br />

prepared.<br />

Neither the IPO nor the DPO can change the scope of the discretion<br />

provided <strong>in</strong> the zone apply<strong>in</strong>g to the land. They cannot be used to<br />

“schedule <strong>in</strong>” or “schedule out” a permit requirement. If a use is “as of<br />

right” <strong>in</strong> the zone, the overlay cannot <strong>in</strong>troduce a permit requirement. If a<br />

use is prohibited <strong>in</strong> the zone, the overlay cannot remove that prohibition. If<br />

a use requires a permit under the zone, the overlay cannot exempt it from<br />

the need for a permit.
