Reform of the <strong>plann<strong>in</strong>g</strong> system<br />
Victoria’s <strong>plann<strong>in</strong>g</strong> system 15<br />
A major reform of the <strong>plann<strong>in</strong>g</strong> system was <strong>in</strong>itiated <strong>in</strong> late 1992 through<br />
the Perrott Committee. Three key objectives were to:<br />
focus on state and local strategic directions to set <strong>plann<strong>in</strong>g</strong> schemes<br />
controls to guide decision-mak<strong>in</strong>g<br />
provide a consistent set of statewide <strong>plann<strong>in</strong>g</strong> scheme controls and<br />
provisions<br />
test the system’s effectiveness by annual monitor<strong>in</strong>g and review.<br />
The Victoria Plan Provisions 4 and new format <strong>plann<strong>in</strong>g</strong> schemes for all<br />
municipalities were developed <strong>in</strong> response to the committee’s<br />
recommendations.<br />
Scheme amendments<br />
Plann<strong>in</strong>g schemes are dynamic documents that can be changed to reflect a<br />
new strategic direction, or a new policy or <strong>plann<strong>in</strong>g</strong> circumstance. They<br />
can also be changed as a result of a review. For example, the council may<br />
amend the scheme to rezone land from one zone to another. <strong>Council</strong>s may<br />
<strong>in</strong>itiate changes to <strong>plann<strong>in</strong>g</strong> schemes. Prior to 23 May <strong>2005</strong>, all <strong>plann<strong>in</strong>g</strong><br />
scheme amendments were required to be approved by the m<strong>in</strong>ister. Recent<br />
amendments to the Plann<strong>in</strong>g and Environment Act 1987 enables the m<strong>in</strong>ister<br />
to authorise a <strong>plann<strong>in</strong>g</strong> authority to approve an amendment. This means<br />
that councils may be able to approve some <strong>plann<strong>in</strong>g</strong> scheme amendments.<br />
Plann<strong>in</strong>g permits<br />
In the Victorian <strong>plann<strong>in</strong>g</strong> system, <strong>plann<strong>in</strong>g</strong> permits are used to approve<br />
land use and development (subdivision, build<strong>in</strong>gs and works). They<br />
generally relate to a specific parcel of land and expire 2 years from the date<br />
of issue (unless otherwise specified <strong>in</strong> the permit).<br />
Plann<strong>in</strong>g permits are legal documents. This means that where conditions<br />
are specified, those conditions must be complied with.<br />
Where specified <strong>in</strong> the <strong>plann<strong>in</strong>g</strong> scheme, a <strong>plann<strong>in</strong>g</strong> permit must be<br />
obta<strong>in</strong>ed to use or develop land for certa<strong>in</strong> purposes. <strong>Council</strong>s decide<br />
whether or not to grant a permit based on:<br />
an assessment of the proposal<br />
the strategies, policies and decision guidel<strong>in</strong>es <strong>in</strong> the <strong>plann<strong>in</strong>g</strong> scheme<br />
any objections received or advice of referral agencies, where relevant.<br />
This decision can be made under delegation by council to council staff.<br />

construct <strong>plann<strong>in</strong>g</strong> schemes.
