destination rates unless the tenderer confirms in the <strong>of</strong>fer that any increase in the<br />

ED,CST/ST or other levy due to increase in the turnover will be absorbed by the<br />

tenderer himself.<br />

1206 For statutory taxes/duties all the <strong>of</strong>fers shall be evaluated as per tax regime as applicable<br />

on the date <strong>of</strong> tender opening.<br />

1300. PACKING<br />

1301. The item(s) tendered will have to undergo arduous transportation be<strong>for</strong>e reaching the<br />

destination and will have to be stored and handled in tropical climatic conditions<br />

(including monsoons) be<strong>for</strong>e they are put to actual use. It is, there<strong>for</strong>e, imperative that<br />

packing <strong>for</strong> every item is decided by taking into consideration, inter-alia, the above vital<br />

factors, so as to eliminate damage/ deterioration <strong>of</strong> item(s) in transit/ transhipment/<br />

handling or during storage.<br />

1302. The specifications <strong>of</strong> the packing proposed shall be indicated. The size and weight <strong>of</strong><br />

each package shall also be indicated.<br />

1303. The packing advice should bring out the weight, dimensions and size <strong>of</strong> each<br />

bundle/package. Where it is not possible to give weight <strong>of</strong> the bundle/package, the<br />

contractor must indicate the volume <strong>of</strong> the bundle/ package, the details <strong>of</strong> contents <strong>of</strong><br />

each bundle/package, number <strong>of</strong> bundles/packages and total weight <strong>of</strong> the items<br />

supplied.<br />

1400. ACCEPTANCE OF BIDS<br />

1401. The purchaser may accept a bid <strong>for</strong> a part or whole <strong>of</strong> the quantity <strong>of</strong>fered, reject any bid<br />

without assigning any reason and may not accept the lowest or any bid.<br />

1402. Acceptance <strong>of</strong> bid will be communicated by Express Letter/FAX or <strong>for</strong>mal acceptance<br />

<strong>of</strong> bid. Such acceptance <strong>of</strong> bid shall be deemed to conclude the contract.<br />

1500. EFFECT AND VALIDITY OF BID<br />

1501. The submission <strong>of</strong> any bid connected with these specifications and documents shall<br />

constitute an agreement that the tenderer shall have no cause <strong>of</strong> action or claim, against<br />

the Purchaser <strong>for</strong> rejection <strong>of</strong> his bid. The Purchaser shall always be at liberty to reject<br />

or accept any bid or bids at his sole discretion and any such action will not be called into<br />

question and the tenderer shall have no claim in that regard against the Purchaser.<br />

1502. The bid shall be kept valid <strong>for</strong> acceptance <strong>for</strong> a minimum period <strong>of</strong> 180 (one hundred<br />

and eighty) calendar days from and including the date set <strong>for</strong> opening <strong>of</strong> bids. In case the<br />

<strong>of</strong>fer is silent about same, it will be presumed that bids are valid <strong>for</strong> 180 days from the<br />

date <strong>of</strong> opening.<br />

1503. Bids shall be deemed to be under consideration immediately after they are opened and<br />

until such time the <strong>of</strong>ficial intimation <strong>of</strong> award <strong>of</strong> contract is made by the Purchaser to<br />

the tenderer. While the bids are under consideration, tenderers and or their<br />

representatives or other interested parties are advised to refrain from contacting the<br />

Purchaser by any means. If necessary, the Purchaser will obtain clarifications on the<br />

bids by requesting <strong>for</strong> such in<strong>for</strong>mation, from any or all the tenderers, either in writing<br />

or through personal contact, as may be considered necessary. <strong>Tender</strong>ers will not be<br />

permitted to change the substance <strong>of</strong> their bids after the bids have been opened.<br />

1600. SPARE PARTS<br />

Where required, the tenderer should quote, apart from main equipment, separately <strong>for</strong><br />

the mandatory spares as well as <strong>for</strong> recommended spares required <strong>for</strong> two years<br />

operation (ref. Tech. Spec. clause-9) except as otherwise required in the Special<br />

Conditions <strong>of</strong> Contract or Technical Specifications. The rates <strong>for</strong> spares should be<br />

indicated both on FOB and C&F basis in the cases <strong>of</strong> <strong>for</strong>eign bids and FOR destination<br />

in the case <strong>of</strong> indigenous bids with complete break up as per bid <strong>for</strong>m. The Purchaser<br />

reserves the right to order any or all the spares as quoted in quantity considered<br />

reasonable by him at the prices quoted by the tenderer and on the terms and conditions<br />
