Factors discouraging sexual harassment:<br />

• Say NO to sexual harassment<br />

• Awareness raising <strong>and</strong> education among young <strong>and</strong> old men <strong>and</strong> <strong>women</strong> workers, employers<br />

<strong>and</strong> families in society to train people to be more outspoken <strong>and</strong> assertive when such situations<br />

arise<br />

• Penalty <strong>and</strong> punishment of harassers based on gravity <strong>and</strong> severity of the cases<br />

• Appropriate behaviour by all actors based on respect to others<br />

• Appropriate law <strong>and</strong> effective enforcement accompanied by regulations, policies, <strong>and</strong> the<br />

establishment of a sexual harassment committee with support system of trained counselors so<br />

that victims can seek immediate redress at national <strong>and</strong> enterprise levels<br />

What to do if you experience sexual harassment at the workplace:<br />

• Say NO, make clear that you are not happy with it<br />

• Do not think that it is a humiliating or personal problem <strong>and</strong> do not blame yourself<br />

• Consult with friends or trustworthy supervisors to find a solution<br />

• Examine if there are others who are also sexually harassed<br />

• Make a written complaint<br />

• Take legal actions<br />

What to do if we witness sexual harassment at the workplace:<br />

• Be aware that the problem is a violation of <strong>rights</strong> at work which affects workers, enterprises <strong>and</strong><br />

society as a whole<br />

• Do not ignore the problem, but get together <strong>and</strong> undertake action<br />

• Support an investigation to be performed with justice <strong>and</strong> sensitivity to stop the sexual violation<br />

<strong>and</strong> to penalize the perpetrator<br />

• Provide moral support to the victim<br />

• Stimulate the organization to take the issue serious <strong>and</strong> formulate procedures in terms of<br />

policies <strong>and</strong> practices<br />

Emphasize that discussing this problem with colleagues is very important. Sharing feelings can<br />

help you to feel relieved. It is also important that persons who listen should take the problem<br />

seriously: always take the victim seriously. Let the person who harasses feel that what he or she is<br />

doing is not good <strong>and</strong> that action will be undertaken if (s)he does not stop. Sexual harassment<br />

often stops if the perpetrator knows that ‘everybody’ knows what (s)he is doing <strong>and</strong> that it is not<br />

accepted.<br />

Sexual harassment in the laws<br />

According to the Labour Code 1997, chapter 6, section 8, article 172 all forms of sexual violation<br />

(harassment) are strictly forbidden.<br />

The provisions to the judiciary <strong>and</strong> criminal law <strong>and</strong> procedure applicable in Cambodia during the<br />

transitional period mentions the following under the heading sexual assault/harassment:<br />

A person who assaults/harasses another person whose sex is the same or different, through<br />

touching or other acts related to sexual manners must be imprisoned for 1 to 3 years.<br />

If the sexual assault is made by cheating, violence, intimidation, if the victim is under 16 years old<br />

or if the perpetrator is in the position of more power over the victim, the punishment must be<br />

doubled.<br />
