3. Successful registration one-stop shop implementation<br />

led to considerable sav<strong>in</strong>gs<br />

In 2008, the <strong>Azerbaijan</strong>i government, with <strong>IFC</strong> support, <strong>in</strong>troduced the “one-stop<br />

shop” system for bus<strong>in</strong>ess registration, which significantly simplified the process<br />

for entrepreneurs to register a bus<strong>in</strong>ess. This endeavor comb<strong>in</strong>ed procedures with<br />

several government <strong>in</strong>stitutions <strong>in</strong>to a s<strong>in</strong>gle registration step <strong>and</strong> therefore made<br />

<strong>and</strong> extraord<strong>in</strong>ary effort much to the convenience <strong>of</strong> the entrepreneur. Prior to <strong>in</strong>troduc<strong>in</strong>g<br />

the one-stop-shop, entrepreneurs needed to complete 13 procedures with a<br />

number <strong>of</strong> government agencies, legally requir<strong>in</strong>g 33-34 days to start up a bus<strong>in</strong>ess<br />

as legal entity <strong>in</strong> <strong>Azerbaijan</strong>. Accord<strong>in</strong>g to 2009 Do<strong>in</strong>g Bus<strong>in</strong>ess Report, <strong>Azerbaijan</strong>’s<br />

rank<strong>in</strong>g on start<strong>in</strong>g a bus<strong>in</strong>ess <strong>in</strong>creased significantly to the 13th global position:<br />

only 6 procedures <strong>and</strong> 7-8 days are now required to start up a bus<strong>in</strong>ess, <strong>of</strong> which<br />

the formal one-stop shop registration takes three days. In addition, client satisfaction<br />

was recorded <strong>in</strong> the <strong>in</strong>-depth <strong>in</strong>terviews with the private sector follow<strong>in</strong>g the s<strong>in</strong>glew<strong>in</strong>dow<br />

establishment. Bus<strong>in</strong>ess registration is now be<strong>in</strong>g carried out by the M<strong>in</strong>istry<br />

<strong>of</strong> Taxes through a very advanced <strong>in</strong>formation system that connects 14 such <strong>of</strong>fices<br />

across the country.<br />

While acknowledg<strong>in</strong>g the government’s success <strong>in</strong> carry<strong>in</strong>g out the reforms, this study<br />

also outl<strong>in</strong>es further possible improvements. To br<strong>in</strong>g bus<strong>in</strong>ess registration closer<br />

to best <strong>in</strong>ternational practices, the government may consider <strong>in</strong>troduc<strong>in</strong>g several<br />

advanced tools <strong>in</strong> a s<strong>in</strong>gle related law: an improved register <strong>of</strong> bus<strong>in</strong>esses, on-l<strong>in</strong>e<br />

application forms, automatic registration etc. The pre-registration process may benefit<br />

from remov<strong>in</strong>g the requirement to obta<strong>in</strong> a confirmation <strong>of</strong> the legal address <strong>of</strong> the<br />

company from the proposed l<strong>and</strong>lord <strong>and</strong> notarization <strong>of</strong> the foundation <strong>and</strong> relevant<br />

registration documents.<br />

4. Bus<strong>in</strong>ess licens<strong>in</strong>g <strong>and</strong> permits should be thoroughly<br />

reviewed <strong>and</strong> modernized<br />

A simplified licens<strong>in</strong>g <strong>and</strong> permits system has a great impact on the development <strong>of</strong><br />

a sound bus<strong>in</strong>ess climate. With the adoption <strong>of</strong> the Presidential Decree No. 782 on<br />

Licens<strong>in</strong>g Rules license issuance procedure, validity period <strong>of</strong> a license, list <strong>of</strong> activities<br />

subject to licens<strong>in</strong>g, licens<strong>in</strong>g fees etc. were closely def<strong>in</strong>ed, effectively reduc<strong>in</strong>g the<br />

number <strong>of</strong> licensable activities from 240 to 56. This <strong>in</strong> turn led to a reduction <strong>of</strong> the<br />

number <strong>of</strong> entrepreneurs requir<strong>in</strong>g a license, as well as reduced f<strong>in</strong>ancial <strong>and</strong> human<br />

resources engaged <strong>in</strong> obta<strong>in</strong><strong>in</strong>g a license.<br />

While licens<strong>in</strong>g rema<strong>in</strong>s more coherent <strong>and</strong> consistent, there is no s<strong>in</strong>gle legal act<br />

that outl<strong>in</strong>es a precise list <strong>of</strong> permits <strong>and</strong> authorizations <strong>and</strong> lays out a clear issuance<br />

procedure. As a result, there is little control over the issuance <strong>of</strong> permits or authorizations<br />

by various government <strong>in</strong>stitutions. The report f<strong>in</strong>ds that the scope <strong>of</strong> coverage<br />

<strong>of</strong> most permits is not precise <strong>and</strong> their application <strong>in</strong> <strong>in</strong>dividual cases is subject to ad<br />

hoc decisions <strong>of</strong> public <strong>of</strong>ficials that leave room for discretionary power. Address<strong>in</strong>g<br />

these issues would significantly improve the bus<strong>in</strong>ess climate.<br />

As a matter <strong>of</strong> priority, the government should start reform<strong>in</strong>g the permit system<br />

by undertak<strong>in</strong>g an <strong>in</strong>ventory <strong>of</strong> all permits <strong>and</strong> other documents currently issued <strong>in</strong><br />

<strong>Azerbaijan</strong> <strong>and</strong> then streaml<strong>in</strong><strong>in</strong>g the issuance process by adopt<strong>in</strong>g an appropriate<br />

legal act. At the same time, the government should also conduct an <strong>in</strong>dividual review<br />
