6. Bus<strong>in</strong>ess Inspections<br />
Accord<strong>in</strong>g to the research results, as well as focus groups, <strong>in</strong>spections are one <strong>of</strong><br />
the four ma<strong>in</strong> obstacles entrepreneurs cite as imped<strong>in</strong>g the development <strong>of</strong><br />
their bus<strong>in</strong>ess.<br />

“In our country, it was always easier to create the bus<strong>in</strong>ess, i.e. go through the registration<br />
process, receive the license for the activity <strong>and</strong> the correspond<strong>in</strong>g certificates. But to keep<br />
<strong>and</strong> secure the duration <strong>of</strong> the bus<strong>in</strong>ess created – here is a real problem, which not all can<br />
manage.”<br />
The absence <strong>of</strong> a s<strong>in</strong>gle state-issued <strong>and</strong> formally approved guidebook on conduct<strong>in</strong>g<br />
<strong>in</strong>spections <strong>and</strong> the uncerta<strong>in</strong>ty <strong>of</strong> the requirements <strong>in</strong> the course <strong>of</strong> <strong>in</strong>spections give<br />
state <strong>in</strong>spectors wide possibilities while limit<strong>in</strong>g the entrepreneur’s rights.<br />
Not hav<strong>in</strong>g a clear underst<strong>and</strong><strong>in</strong>g <strong>of</strong> the frequently chang<strong>in</strong>g, strict, sometime unpredictable<br />
<strong>and</strong> contradict<strong>in</strong>g requirements, it is easier for the entrepreneur to solve<br />
the problems related to the <strong>in</strong>spections through channels other than legal solutions.<br />
Given their relative frequency, the practice becomes almost a permanent solution to<br />
the on-site visits <strong>of</strong> the <strong>in</strong>spectors:<br />

“The <strong>in</strong>spector’s work consists <strong>in</strong> com<strong>in</strong>g , <strong>and</strong> my duty – to meet him <strong>in</strong> such a way so<br />
as to not spoil our relationship.”<br />
As mentioned above, <strong>in</strong>spections preparation <strong>and</strong> on-site visits are not regulated<br />
by specific legal norms. The norms that exist do not sufficiently clarify how the<br />
<strong>in</strong>spections are prepared, conducted, what is be<strong>in</strong>g checked, <strong>and</strong> how <strong>and</strong> what the<br />
report<strong>in</strong>g <strong>and</strong> penaliz<strong>in</strong>g mechanisms are. There have <strong>in</strong>deed been legal attempts to<br />
more strictly regulate the <strong>in</strong>spections, but <strong>in</strong> practice, this rema<strong>in</strong>s an unclear area<br />
<strong>of</strong> the public sector. Therefore <strong>in</strong> most agencies the <strong>in</strong>formal means <strong>of</strong> ensur<strong>in</strong>g<br />
compliance still exists. Entrepreneurs are still <strong>in</strong>cl<strong>in</strong>ed to resolve or circumvent<br />
st<strong>and</strong>ards’ requirements <strong>in</strong> an <strong>in</strong>formal way <strong>and</strong> the read<strong>in</strong>ess <strong>of</strong> the <strong>in</strong>spectors to<br />
accept <strong>in</strong>formal payments have created a vicious circle.<br />
