While the Rules specify limits for the amount <strong>of</strong> time agencies may take to process<br />

applications, they do not provide for any sanctions for non-observance <strong>of</strong> the deadl<strong>in</strong>es<br />

by licensors dur<strong>in</strong>g the application process nor do they establish the “silence<br />

is consent” pr<strong>in</strong>ciple. This <strong>in</strong> turn negatively affects the overall application review<br />

process. Therefore, it is advisable to <strong>in</strong>troduce the “silence is consent” pr<strong>in</strong>ciple,<br />

which can prevent delays <strong>and</strong> un<strong>of</strong>ficial payments dur<strong>in</strong>g the application process<br />

<strong>and</strong> reduce the process<strong>in</strong>g time. The pr<strong>in</strong>ciple is based on the follow<strong>in</strong>g assumption:<br />

government <strong>of</strong>ficials have to respond to the application <strong>of</strong> a citizen or entrepreneur<br />

<strong>in</strong> a fixed time period, otherwise the apply<strong>in</strong>g citizen/entrepreneur is endowed with<br />

the right to the service (license) without a decision from the government <strong>of</strong>ficial (i.e.<br />

tacit authorization).<br />

Moreover, pursuant to the Rules, where deemed necessary, a license-issu<strong>in</strong>g authority can<br />

apply to other government agencies for an op<strong>in</strong>ion <strong>in</strong> connection with the specificities<br />

<strong>of</strong> a licensed activity. This request must be (i) reviewed by the authority receiv<strong>in</strong>g the<br />

request for the op<strong>in</strong>ion with<strong>in</strong> 5 days <strong>and</strong> (ii) followed by the issue <strong>of</strong> an <strong>of</strong>ficial op<strong>in</strong>ion.<br />

However, the circumstances <strong>in</strong> which this <strong>of</strong>ficial op<strong>in</strong>ion may be required are not<br />

provided for by the rules <strong>and</strong> leave this matter at the discretion <strong>of</strong> licens<strong>in</strong>g agencies.<br />

4.3.2 Cost <strong>of</strong> licens<strong>in</strong>g<br />

Accord<strong>in</strong>g to the survey results, the average cost <strong>of</strong> licens<strong>in</strong>g (<strong>in</strong>clud<strong>in</strong>g <strong>of</strong>ficial <strong>and</strong><br />

un<strong>of</strong>ficial payments) varies between the <strong>in</strong>dividual entrepreneurs <strong>and</strong> small <strong>and</strong> medium<br />

enterprises (for a detailed breakdown <strong>of</strong> the surveyed companies <strong>and</strong> respective<br />

sectors, please consult Table 1.1). Individual entrepreneurs spend on average 276<br />

<strong>Azerbaijan</strong>i manats ($340) while small <strong>and</strong> medium enterprises spend on average<br />

564 <strong>Azerbaijan</strong>i manats ($696) for receiv<strong>in</strong>g a license (see Chart 4.4). Moreover,<br />

nearly 39 percent <strong>of</strong> <strong>in</strong>dividual entrepreneurs <strong>and</strong> 25 percent <strong>of</strong> surveyed SME’s who<br />

obta<strong>in</strong>ed a license <strong>in</strong> 2007 resorted to un<strong>of</strong>ficial payments (see Chart 4.5). These<br />

figures confirm the assumptions that licens<strong>in</strong>g procedures are unclear <strong>and</strong> some cases<br />

<strong>of</strong> un<strong>of</strong>ficial payments still exist <strong>in</strong> the licens<strong>in</strong>g procedure. It is worth not<strong>in</strong>g that the<br />

high volume <strong>of</strong> un<strong>of</strong>ficial payments for licens<strong>in</strong>g can be significant h<strong>in</strong>drance for startup<br />

entrepreneurs to entry <strong>in</strong>to bus<strong>in</strong>ess.<br />
