set out <strong>in</strong> the law on Banks 21 , while the documents required for obta<strong>in</strong><strong>in</strong>g broadcast<strong>in</strong>g<br />

license are listed <strong>in</strong> the law on Television <strong>and</strong> Radio Broadcast<strong>in</strong>g 22 .<br />

Pursuant to Article 2 <strong>of</strong> the Licens<strong>in</strong>g Rules, where deemed necessary, a license-issu<strong>in</strong>g<br />

authority can apply to other government agencies for an op<strong>in</strong>ion <strong>in</strong> connection with<br />

the specificities <strong>of</strong> a licensed activity. It appears that an op<strong>in</strong>ion may be required by a<br />

license-issu<strong>in</strong>g authority to clarify an aspect <strong>of</strong> licensed activity about which it may<br />

not have specific knowledge. The circumstances <strong>in</strong> which this <strong>of</strong>ficial op<strong>in</strong>ion may be<br />

required are not elaborated <strong>in</strong> the Rules.<br />

If the applicant is refused a license, an <strong>of</strong>ficial response to this effect must expla<strong>in</strong> the<br />

grounds for such refusal. However, the Licens<strong>in</strong>g Rules do not conta<strong>in</strong> a list <strong>of</strong> specific<br />

grounds on which the issue <strong>of</strong> a license can be refused <strong>and</strong> leave this matter to be resolved<br />

by the specialized laws that deal with specific sector licenses. The analysis suggests<br />

that specialized licens<strong>in</strong>g laws do not necessarily comply with the framework licens<strong>in</strong>g<br />

law or fail to set clear, predictable, <strong>and</strong> transparent criteria for obta<strong>in</strong><strong>in</strong>g licenses (see Box<br />

4.2). This <strong>in</strong> turn leaves a certa<strong>in</strong> degree <strong>of</strong> discretionary power to licens<strong>in</strong>g bodies.<br />

Box 4.2 The procedure for receiv<strong>in</strong>g air transportation license is unclear<br />

Under the Licens<strong>in</strong>g Rules, the State Adm<strong>in</strong>istration for Civil Aviation is empowered to issue a license for the carriage <strong>of</strong> cargo <strong>and</strong> passengers<br />

by air transport. However, this agency does not currently issue such licenses <strong>in</strong> practice. Commercial flights are operated on the basis <strong>of</strong> air<br />

operator certificates issued by the State Concern <strong>Azerbaijan</strong>i Airl<strong>in</strong>es, even though one air operator certificate states that “flight operations<br />

specified on the present certificate come <strong>in</strong>to effect upon obta<strong>in</strong><strong>in</strong>g a special permit (license).”<br />

While the Rules specify limits for the amount <strong>of</strong> time agencies can take to process<br />

applications (15 days), they do not provide for any sanctions for non-observance <strong>of</strong><br />

the deadl<strong>in</strong>es by licensors dur<strong>in</strong>g the application process nor do they establish the<br />

“silence is consent” pr<strong>in</strong>ciple. As a result, the time to obta<strong>in</strong> a license <strong>in</strong> practice may<br />

vary <strong>and</strong> the licens<strong>in</strong>g applicant can adversely be affected by the delays.<br />

4.2 Licens<strong>in</strong>g coverage<br />

Adoption <strong>of</strong> the Licens<strong>in</strong>g Rules reduced the number <strong>of</strong> licensable activities from 240<br />

to 30. However, subsequent amendments to the Rules have <strong>in</strong>creased the number<br />

<strong>of</strong> licensable activities from 30 to 56 (see Chart 4.1). Nevertheless, the current situation<br />

represents a significant step forward <strong>in</strong> terms <strong>of</strong> number <strong>of</strong> activities subject to<br />

licens<strong>in</strong>g.<br />
