4.1 Licens<strong>in</strong>g: the legal framework<br />
A license is a document which is required for cont<strong>in</strong>ued activity <strong>of</strong> a certa<strong>in</strong> type or<br />
requir<strong>in</strong>g a particular expertise 19 . Therefore, if a bus<strong>in</strong>ess requires a license accord<strong>in</strong>g<br />
to the law, an entrepreneur must obta<strong>in</strong> the required license before start<strong>in</strong>g his/her<br />
activity.<br />
Box 4.1 Def<strong>in</strong>ition <strong>of</strong> a license provided for by the Licens<strong>in</strong>g Rules<br />
Paragraph I – General Provisions<br />
“A license represents an <strong>of</strong>ficial document, authoriz<strong>in</strong>g legal entities, as well as <strong>in</strong>dividuals engaged <strong>in</strong> entrepreneurial activity without creat<strong>in</strong>g<br />
a legal entity irrespective <strong>of</strong> their organizational <strong>and</strong> legal form, to implement certa<strong>in</strong> types <strong>of</strong> entrepreneurial activity.”<br />
The licens<strong>in</strong>g regime <strong>in</strong> <strong>Azerbaijan</strong> is ma<strong>in</strong>ly regulated by the follow<strong>in</strong>g legal acts:<br />
• Presidential Decree No. 782 on Improvement <strong>of</strong> Regulations <strong>of</strong> Grant<strong>in</strong>g Special<br />
Permits (Licenses) for Some Types <strong>of</strong> Activities dated September 2, 2002;<br />
• Resolution <strong>of</strong> the Cab<strong>in</strong>et <strong>of</strong> M<strong>in</strong>isters No. 174 on Additional Conditions for<br />
Issuance <strong>of</strong> Special Permits (Licenses) for Certa<strong>in</strong> Types <strong>of</strong> Activities dated<br />
November 7, 2002.<br />
The adoption <strong>of</strong> these legal acts was a substantial step forward <strong>in</strong> terms <strong>of</strong> streaml<strong>in</strong><strong>in</strong>g<br />
the overall licens<strong>in</strong>g regime. Thus, licens<strong>in</strong>g rules set up:<br />
• General provisions for the licens<strong>in</strong>g <strong>of</strong> certa<strong>in</strong> activities;<br />
• License issuance procedure;<br />
• Validity period <strong>of</strong> a license;<br />
• Time frame for process<strong>in</strong>g with application for a license;<br />
• Procedure for suspension <strong>and</strong> cancellation <strong>of</strong> a license;<br />
• List <strong>of</strong> activities subject to licens<strong>in</strong>g;<br />
• Government agencies issu<strong>in</strong>g licenses;<br />
• Licens<strong>in</strong>g fees.<br />
The Cab<strong>in</strong>et <strong>of</strong> M<strong>in</strong>isters Decree No.174 <strong>in</strong> turn specifies additional conditions for<br />
specific activities subject to licens<strong>in</strong>g.<br />
However, there is still room for further improvement <strong>of</strong> the Licens<strong>in</strong>g Rules from<br />
the legislative <strong>and</strong> procedural po<strong>in</strong>t-<strong>of</strong>-view. Even though the Licens<strong>in</strong>g Rules <strong>and</strong><br />
Resolution No. 174 <strong>of</strong> the Cab<strong>in</strong>et <strong>of</strong> M<strong>in</strong>isters specify that no other document other<br />
than those identified <strong>in</strong> these regulations can be requested from a license applicant,<br />
it is clear from various laws that, <strong>in</strong> some cases at least, additional documents are required<br />
