6.6 Recommendations<br />

6.6.1 Establish an efficient system <strong>of</strong> government control<br />

An efficient system <strong>of</strong> government control <strong>in</strong>cludes three components:<br />

1) a risk assessment system;<br />

2) a st<strong>and</strong>ard procedure for conduct<strong>in</strong>g <strong>in</strong>spections <strong>and</strong> present<strong>in</strong>g f<strong>in</strong>d<strong>in</strong>gs, address<strong>in</strong>g<br />

also frequency <strong>and</strong> duration <strong>of</strong> <strong>in</strong>spections;<br />

3) checklists to be used by <strong>in</strong>spectors based on revised <strong>and</strong> up-to-date regulations<br />

on the technical requirements for compliance.<br />

Expected Impact<br />

With these elements <strong>in</strong> place, the system <strong>of</strong> government control will be able to<br />

perform its ma<strong>in</strong> function, which is to encourage compliance with the law <strong>and</strong> prevent<br />

violations.<br />

6.6.2 Implement risk-based selection mechanisms <strong>of</strong> SMEs to<br />

be <strong>in</strong>spected<br />

On the basis <strong>of</strong> risk assessment, the volume <strong>of</strong> <strong>in</strong>spections can be reduced without<br />

endanger<strong>in</strong>g the public. This approach has three elements:<br />

1. Each control authority identifies, with<strong>in</strong> the scope <strong>of</strong> its area <strong>of</strong> expertise, potential<br />

public <strong>and</strong> environmental safety hazards <strong>in</strong>herent <strong>in</strong> the range <strong>of</strong> bus<strong>in</strong>ess<br />

activities. The authority then categorizes bus<strong>in</strong>esses accord<strong>in</strong>g to the degree that<br />

such hazards typically exist <strong>in</strong> those bus<strong>in</strong>esses;<br />

2. For each category, the frequency <strong>of</strong> <strong>in</strong>spections is determ<strong>in</strong>ed based on the<br />

potential risk: high-risk bus<strong>in</strong>esses are <strong>in</strong>spected <strong>of</strong>ten, medium-risk bus<strong>in</strong>esses<br />

are <strong>in</strong>spected much less <strong>of</strong>ten; <strong>and</strong> low-risk bus<strong>in</strong>esses are exempt from<br />

<strong>in</strong>spection;<br />

3. Where a bus<strong>in</strong>ess falls <strong>in</strong>to a risk category to be <strong>in</strong>cluded <strong>in</strong> the list <strong>of</strong> planned<br />

<strong>in</strong>spections, the frequency <strong>of</strong> <strong>in</strong>spections <strong>of</strong> a particular bus<strong>in</strong>ess further depends<br />

on its record with respect to <strong>in</strong>spection f<strong>in</strong>d<strong>in</strong>gs. Thus, if a bus<strong>in</strong>ess consistently<br />

abides by all applicable laws, it need not be <strong>in</strong>spected as frequently.<br />

The degree to which actual risk is a factor <strong>in</strong> target<strong>in</strong>g bus<strong>in</strong>esses for <strong>in</strong>spection reflects<br />

the degree to which best practices are operat<strong>in</strong>g <strong>in</strong> the country.<br />

In <strong>in</strong>ternational best practices, the control authorities focus on high-risk <strong>and</strong> highoccupancy<br />

enterprises such as chemical plants, c<strong>in</strong>emas <strong>and</strong> theaters, railway stations,<br />

educational facilities, supermarkets, <strong>and</strong> bus<strong>in</strong>esses where there is a high probability<br />

<strong>of</strong> non-compliance because <strong>of</strong> previous violations.<br />

A risk-based <strong>in</strong>spection system must be flexible enough to <strong>in</strong>clude some exceptions<br />

with regard to r<strong>and</strong>om <strong>in</strong>spections. However, the authority to conduct such <strong>in</strong>spections<br />

should be limited so as not to allow government agencies to underm<strong>in</strong>e the<br />

underly<strong>in</strong>g pr<strong>in</strong>ciples <strong>of</strong> the risk-based approach. A r<strong>and</strong>om <strong>in</strong>spection should be<br />

conducted only if there is a clear threat to the public or the environment, under very<br />
