9. Setting the Regulatory Framework<br />

Box 9.4 ANNEX II of EU Directive 2001/14 - Services<br />

to Be Supplied to <strong><strong>Rail</strong>way</strong> Undertakings<br />

1. The minimum access package shall comprise:<br />

a) handling requests <strong>for</strong> infrastructure capacity<br />

b) the right to utilize the capacity that is granted<br />

c) use of running track points and junctions<br />

d) train control including signaling, regulating, dispatching, communication,<br />

and providing in<strong>for</strong>mation on train movement<br />

e) all other in<strong>for</strong>mation required to implement or operate the service <strong>for</strong><br />

which capacity has been granted<br />

2. Track access to services facilities and supply of services shall comprise:<br />

a) use of electrical supply equipment <strong>for</strong> traction current, where available<br />

b) refueling facilities<br />

c) passenger stations, their buildings, and other facilities<br />

d) freight terminals<br />

e) marshalling yards<br />

f) train <strong>for</strong>mation facilities<br />

g) storage sidings<br />

h) maintenance and other technical facilities<br />

3. Additional services may comprise:<br />

a) traction current<br />

b) pre-heating of passenger trains<br />

c) supply of fuel, shunting, and all other services provided at the access<br />

services facilities mentioned above<br />

d) tailor-made contracts <strong>for</strong>:<br />

- control of transport of dangerous goods<br />

- assistance in running abnormal trains<br />

4. Ancillary services may comprise:<br />

a) access to telecommunication network<br />

b) provision of supplementary in<strong>for</strong>mation<br />

c) technical inspection of rolling stock<br />

Developing access charges<br />

The charging system <strong>for</strong> access is one of the most complex issues of third-party<br />

access. First, to be able to calculate the cost of providing infrastructure services,<br />

accounts <strong>for</strong> infrastructure must be separated from accounts <strong>for</strong> rail operations.<br />

Second, a decision must be made about the principles on which charges should be<br />

determined. Two broad options are marginal cost pricing and full cost recovery.<br />

Most economists favor marginal cost pricing, which charges <strong>for</strong> costs incurred <strong>for</strong><br />

each service. However, the marginal cost of infrastructure is normally much less<br />
