From Practice: IP <strong>Management</strong> <strong>in</strong> <strong>Japan</strong>ese Companies 381<br />

The first po<strong>in</strong>t <strong>of</strong> contention is the content <strong>of</strong> the IP reports. In other words,<br />

s<strong>in</strong>ce the <strong>in</strong>formation relat<strong>in</strong>g to patents is already publicly disclosed, why is it<br />

necessary to re-summarize this <strong>in</strong>formation aga<strong>in</strong>? This is work best done by the<br />

market analysts, as there is no need for the companies to compile this, <strong>and</strong> no<br />

value is added.<br />

The second po<strong>in</strong>t claims that IP, or the company’s <strong>in</strong>tellectual assets composed<br />

ma<strong>in</strong>ly <strong>of</strong> patents, is confidential <strong>in</strong>-house <strong>in</strong>formation. Publiciz<strong>in</strong>g this <strong>in</strong>formation<br />

<strong>in</strong> itself may result <strong>in</strong> a reduction <strong>in</strong> the company’s value. For example, <strong>in</strong>formation<br />

such as important licens<strong>in</strong>g facts, the position <strong>of</strong> the company’s core<br />

patents, IP strategy, <strong>and</strong> technology strategy are all confidential, <strong>and</strong> announc<strong>in</strong>g<br />

this to the market is very difficult.<br />

The third po<strong>in</strong>t is similar to the second po<strong>in</strong>t. It says that rather than simply list<strong>in</strong>g<br />

patents for disclosure like numerical data, it is more important for the company<br />

to have the corporate strength to produce IP <strong>in</strong> the first place, to have <strong>in</strong>tellectual<br />

capital, <strong>and</strong> to have a basic company stance. For this reason, without the<br />

disclosure <strong>of</strong> this fundamental corporate <strong>in</strong>formation, it will not constitute true IP<br />

disclosure. This task is very difficult, <strong>and</strong> should be carried out <strong>in</strong>side the company,<br />

but it is not someth<strong>in</strong>g to be announced outside the company. Based on<br />

these three reasons, many companies are aga<strong>in</strong>st IP <strong>in</strong>formation disclosure.<br />

Nevertheless, there are also companies that feel that IP reports are necessary.<br />

One <strong>of</strong> these companies is Asahi Kasei. Mr. Tsurumi, the former head <strong>of</strong> Asahi<br />

Kasei’s IP center, expla<strong>in</strong>ed it this way.<br />

“I believe that one <strong>of</strong> the major premises beh<strong>in</strong>d the issue <strong>of</strong> IP report<strong>in</strong>g is the<br />

necessity for <strong>in</strong>formation disclosure. In my underst<strong>and</strong><strong>in</strong>g, account<strong>in</strong>g <strong>in</strong>formation<br />

is no more than past <strong>in</strong>formation. However, <strong>in</strong>stitutional <strong>in</strong>vestors need to <strong>in</strong>vest<br />

for the long term <strong>of</strong> five or ten years. Therefore, s<strong>in</strong>ce they cannot make their<br />

judgments based on the past results <strong>of</strong> account<strong>in</strong>g <strong>in</strong>formation alone, they are<br />

look<strong>in</strong>g for various k<strong>in</strong>ds <strong>of</strong> <strong>in</strong>formation. IP reports are one type <strong>of</strong> this <strong>in</strong>formation.<br />

What k<strong>in</strong>d <strong>of</strong> core technology <strong>and</strong> core competence does this company use to<br />

make a pr<strong>of</strong>it? Is the company thoroughly aware <strong>of</strong> this? It is also desirable for the<br />

company to use charts to show that it is apply<strong>in</strong>g an IP bus<strong>in</strong>ess model to earn<br />

pr<strong>of</strong>its.<br />

In the case <strong>of</strong> Asahi Kasei, we do not yet prepare IP reports for each <strong>of</strong> our divisions<br />

<strong>and</strong> member companies. Although I had considerable discussions with the<br />

heads <strong>of</strong> materials departments at other companies <strong>in</strong> the process <strong>of</strong> prepar<strong>in</strong>g IP<br />

reports, now there are no bus<strong>in</strong>ess areas, companies, or member companies that<br />

are prepar<strong>in</strong>g clear stories <strong>in</strong> the format that I mentioned. Simply put, <strong>Japan</strong>ese<br />

companies are not carry<strong>in</strong>g out bus<strong>in</strong>ess development with an awareness <strong>of</strong> this<br />

k<strong>in</strong>d <strong>of</strong> th<strong>in</strong>g. Therefore, <strong>in</strong> order to be able to prepare a report, the company must<br />

first have a clear awareness <strong>of</strong> itself. By do<strong>in</strong>g this, the company can properly develop<br />

its bus<strong>in</strong>ess. I underst<strong>and</strong> that this is one way to set policy direction. We<br />

need to take this approach <strong>and</strong> prepare a story for the development <strong>of</strong> our bus<strong>in</strong>ess,<br />

<strong>and</strong> put this <strong>in</strong>to writ<strong>in</strong>g. As there are many <strong>Japan</strong>ese companies that cannot<br />

do this, the <strong>in</strong>tention to keep pace by properly prepar<strong>in</strong>g this is actually a policy<br />

purpose, <strong>and</strong> Asahi Kasei has adopted this policy.
