Even the National REDD WorkingGroup established by the REDD Regulation to oversee the REDDimplementation does not include an indigenous representative amongits 15 members. AMAN, et. al. stated that:“Indonesia's submissions to the FCPF are entirely silent about anymeasures that maybe taken to secure indigenous peoples' rights inrelation to REDD activities...According to Indonesia, based on theREDD Regulation, indigenous peoples can be “REDD Implementers”where they have some form of State-recognized 'forest use rights' or, incases where they do not, 'these groups maybe involved in monitoring..'At no point does Indonesia even mention a right to participate indecision making and consent to REDD activities..”• The submitting organizations requested the CERD to recommend that“Indonesia ensures that all actions undertaken towards the fulfillmentof commitments under the UNFCCC and related instruments,including preparatory and other REDD activities, ...are fully consistentwith its obligations under the ICERD and the UNDRIP.” Furthermore,the Committee requests “that the World Bank and its Forest CarbonPartnership Facility ensure that indigenous peoples' rights..are fullyaccounted for and upheld in REDD preparatory activities that fall84 <strong>Guide</strong> on Climate Change and Indigenous Peoples
within its mandate.”• AMAN, et. al. subsequently sent a letter dated 16 July 2009 to theFCPF and to donors asking them not to approve the R-Plan ofIndonesia until such time that adequate consultations were held. Thiswas discussed in the Participants Committee (PC) meeting in June 2009and the resolution adopted by the PC was that the final approval will bedone after the response of Indonesia to the concerns are made.• Several donor governments (Netherlands, Norway, UK) made theircomments and stated that the approval of Indonesia's R-PP should beconditional on its performance and reporting in ensuring stakeholderinvolvement, including AMAN, and that this report should be receivedin the next PC meeting in October 2009. NGOs like The NatureConservancy and the Rainforest Foundation Norway sent their critiqueand proposals on how to address these issues. They issued a similar callas the governments mentioned above.• The PC noted the need for progress in the following areas:1. Develop a plan and schedule for further stakeholder consultationswith local communities on the development and implementation ofthe R-PP, includingrepresentatives fromforest-dependantindigenous peoples,other forest dwellersand civil societyorganizations,including AMAN.This should includea means to resolvedisputes.2. Clarify and/orfurther developrelevant policies,laws, regulations, orguidelines concerningland tenure andresource access, andthe distribution ofcosts and benefits forREDD demonstrationprojects, ensuringthat the rightsand interests ofrelevant stakeholders,Sinar Resmi Declaration 29• Affirm that all initiatives onREDD must guarantee theacknowledgment and protectionof Indigenous Peoples' rights,including protecting our rightsto land, customary domainsand ecosystems and providingmaximum opportunities forindigenous communities.• Agree and insist that, in theabsence of such guarantees,Indigenous Peoples will reject theimplementation of all REDD plansand any other climate changemitigation initiatives.• Urge the World Bank, in particular,to implement the UNDRIP in allBank policies relating to REDDand to hold consultations withIndonesian indigenous communitiesimmediately.PART V: REDD/REDD+ and Indigenous Peoples 85
