Regarding after-market systems and nomadic devices a technical solution is needed, inorder to disable functions which are not intended for use by the driver while driving or atleast to provide a specific warning. One option could be that the vehicle manufacturersupplies a “vehicle moving” signal, other solutions can be found in Japan today using anelectrical switch on the parking brake (if the parking brake is applied, the vehicle can notmove and the driver has unlimited access to the system).Concerning the current version of the ESoP, Principle 4.3 allows uninterruptiblesequences of interactions if they are not long. This principle should be amended by adefinition of “long”.4.4 System UseClearly the driver is ultimately responsible for system use while driving (ViennaConvention). Therefore driver information concerning safe use is very important. In casean employer requires that the driver uses certain systems or functionalities as part of hiswork, the distribution of responsibility needs to clarified (see Annex D).
