Monitoring and Enforcement 78R-MS-5R-MS-6R-MS-7R-MS-8R-MS-9R-MS-10R-MS-11Member States should ensure that regularly updated information isavailable on the definition and dynamics of the market for after-marketand nomadic devices to be informed about the evolution of the marketand of the techniques.Member States continue evaluation and monitoring of the impact of theESoP and report to the European Commission about the results.Member States should ensure that data collection is sufficiently detailed inorder to perform further evaluation and monitoring the safety-impact ofin-vehicle information and communication systems especially ofaftermarket systems and nomadic devices.Member States should take measures (for example legislation) to ensuresecure fixing of aftermarket systems and nomadic devices according toECE R21, or equivalent (for details please see Annex G).Member States should continue to actively enforce existing Health andSafety legislation concerning at-work driving practices.Member States should take measures to ensure that use of nomadicdevices by the driver while driving is hands-free.Member States should identify and take necessary actions on theunintended use or misuse 79 of visual entertainment systems by driverswhile driving (e.g. movies, TV, video games).7. Summary of Recommendations7.1 Concerning ESoPR-ESoP-1R-ESoP-2R-ESoP-3R-ESoP-4R-ESoP-5R-ESoP-6Clarify and adequately incorporate the distribution of responsibilities intothe scope.Expand the scope of the principles to include “post-manufacture” issuesincluding service providers and Fleet Managers and Employers asdescribed above – see Annex D for an initial draft.Explicitly address information presentation by service providers (e.g.running text) in the scope.Explicitly address manufactures of specific systems in the Scope (e.g.medical vehicle systems, express delivery systems).Add specific criterion to Principle 2.4 (“visual displays should bepositioned as close as practicable to the driver's normal line of sight”).Possible solution: adopt the 30°-rule from the current version 2.1 of theAmerican AAM-guideline for visually intensive displays and add a precisedefinition on “visually intensive displays”.Add definition of “long” in Principle 4.3 (“The system should not requirelong and uninterruptible sequences of interactions”).
