Response <strong>to</strong> <strong>FY</strong> <strong>2007</strong> Federal <strong>Tri</strong>ennial Re<strong>view</strong>Chapter 53 of Title 49, United States Code, requires the Federal <strong>Transit</strong>Administration (FTA) <strong>to</strong> re<strong>view</strong> and evaluate how FTA grant recipientshave used Urbanized Area Formula Grants (FTA Section 5307 funds)and complied with relevant statu<strong>to</strong>ry and administrative requirementsat least every three years. This requirement is enumerated in 49U.S.C. 5307(i), as follows:(2) At least every three years, the Secretary [of Transportation]shall re<strong>view</strong> and evaluate completely the performance of arecipient in carrying out the recipient’s program, specificallyreferring <strong>to</strong> compliance with statu<strong>to</strong>ry and administrativerequirements and the extent <strong>to</strong> which actual program activitiesare consistent with the activities proposed under subsection(d) of this section and the planning process required undersection 5303-5306 of this title.(3) The Secretary may take appropriate action consistent with there<strong>view</strong>, audit and evaluation under this subsection, includingmaking an appropriate adjustment in the amount of a grant orwithdrawing the grant.The <strong>Tri</strong>ennial Re<strong>view</strong> analyzes and evaluates grantee performance andcompliance in 23 distinct areas, which are not listed here for brevity.The latest re<strong>view</strong> of the <strong>Tri</strong> <strong>Delta</strong> <strong>Transit</strong> system, conducted in August2006, included the following findings and corrective actions, whichmainly consist of updating documentation and complying with recentchanges in emphasis in administrative requirements by FTA. <strong>Tri</strong> <strong>Delta</strong><strong>Transit</strong> staff <strong>to</strong>ok corrective action in Fall 2006 <strong>to</strong> comply with thefollowing findings:1. Accurately report un-liquidated obligations for Grant CA 90Y30800 and provide assurances <strong>to</strong> FTA that ECCTAunderstands the correct method for reporting on un-obligatedfunds (within 60 days).2. Complete development of service standards and policies, andsubmit Title VI program <strong>to</strong> FTA (within 90 days).62
