CONDIZIONI GENERALI DI VENDITA CONDITIONS OF SALE<br />
Art. 1 I beni possono essere venduti in lotti o singolarmente<br />
ad insindacabile giudizio della ART S.r.l. (di seguito<br />
ART o Casa d’Aste). Le aste saranno tenute in locali<br />
aperti al pubblico da ART che agisce unicamente come<br />
mandataria nel nome e nell’interesse di ciascun<br />
venditore (il nome del quale è trascritto in tutti i registri<br />
previsti dalle vigenti leggi). Gli effetti della vendita<br />
influiscono direttamente sul compratore e sul venditore.<br />
ART non assume nessuna responsabilità nei<br />
confronti dell’aggiudicatario, del venditore, o di qualsiasi<br />
altro terzo in genere.<br />
Art. 2 Gli oggetti sono venduti/aggiudicati al miglior offerente,<br />
e per contanti. Nel caso in cui sorgessero delle<br />
contestazioni tra più aggiudicatari, il Banditore, a suo<br />
insindacabile giudizio, rimetterà in vendita il bene<br />
che potrà essere nuovamente aggiudicato nella medesima<br />
asta; in ogni caso gli aggiudicatari che avessero<br />
sollevato delle contestazioni restano vincolati all’offerta<br />
fatta in precedenza che ha dato luogo alla nuova<br />
aggiudicazione. In caso di mancata nuova aggiudicazione<br />
il Banditore, a suo insindacabile giudizio,<br />
comunicherà chi deve intendersi aggiudicatario del<br />
bene. Ogni trasferimento a terzi dei lotti aggiudicati<br />
non sarà opponibile ad ART che considererà quale<br />
unico responsabile del pagamento l’aggiudicatario.<br />
La partecipazione all’asta in nome e per conto di terzi<br />
potrà essere accettata da ART solo previo deposito<br />
presso gli Uffici della Casa d’Aste - almeno tre giorni<br />
prima dell’asta - di adeguate referenze bancarie e di<br />
una procura notarile ad negotia.<br />
Art. 3 ART si riserva il diritto di ritirare dall’asta qualsiasi<br />
lotto. Il Banditore, durante l’asta, ha facoltà di accorpare<br />
e/o separare i lotti e di variare l’ordine di vendita.<br />
Il banditore può, a suo insindacabile giudizio, ritirare<br />
i lotti che non raggiungano il prezzo di riserva<br />
concordato tra ART ed il venditore.<br />
Art. 4 L’aggiudicatario corrisponderà ad ART un corrispettivo<br />
pari al 21% sul prezzo di aggiudicazione comprensivo<br />
di I.V.A. Qualunque ulteriore onere o tributo<br />
relativo all’acquisto sarà comunque a carico<br />
dell’aggiudicatario. Per i lotti che fossero in temporanea<br />
importazione, provenendo da paesi non UE oltre<br />
ai corrispettivi d’asta di cui sopra l’aggiudicatario, se<br />
residente in un Paese UE, dovrà corrispondere ogni<br />
altra tassa conseguente, oltre a rimborsare tutte le<br />
spese necessarie a trasformare da temporanea a definitiva<br />
l’importazione (i beni interessati saranno indicati<br />
con il segno**). Si ricorda che qualora il venditore<br />
fosse un soggetto I.V.A. l’aggiudicatario dovrà<br />
corrispondere anche le imposte conseguenti (i beni interessati<br />
saranno contrassegnati dal segno °°).<br />
Art. 5 Al fine di garantire la trasparenza dell’asta tutti coloro<br />
che sono intenzionati a formulare offerte devono<br />
compilare una scheda di partecipazione con i dati<br />
personali e le referenze bancarie. ART si riserva il diritto<br />
di verificare le referenze fornite e di rifiutare alle<br />
persone non gradite la partecipazione all’asta. All’atto<br />
della compilazione ART consegnerà un cartellino<br />
identificativo, numerato, che dovrà essere esibito al<br />
banditore per formulare le offerte.<br />
Art. 6 ART può accettare mandati per l’acquisto (tramite<br />
sia offerte scritte che telefoniche) effettuando rilanci<br />
tramite il Banditore, in gara con le persone partecipanti<br />
in sala. In caso di offerte identiche l’offerta<br />
scritta preverrà su quella orale.<br />

Art. 1 The goods may be sold in lots or singularly at the sole<br />
discretion of ART S.r.l (hereafter referred to as<br />
ART or Auction house). The auctions will be held by<br />
ART in premises open to the public. ART will act as<br />
sole agent, on an exclusive basis, in the name of and<br />
in the interest of each Seller (whose names are registered<br />
in special books as provided by the applicable<br />
laws). The sale shall have direct effects upon the<br />
Buyer and the Seller. ART shall not be liable towards<br />
the Buyer, Seller or any third party.<br />
Art. 2 The lots are sold/knocked down to the highest bidder,<br />
and by cash. If disputes should arise between two or<br />
more bidders, the lot, at the sole discretion of the<br />
Auctioneer, will be re-offered and resold during the<br />
same auction; in any event the bidders that brought<br />
up the dispute will remain bound by the offer that<br />
gave rise to the new bid. In the event of no new bid,<br />
the auctioneer, at his/her sole discretion, will state<br />
who is the Buyer of the lot. ART shall not accept any<br />
kind of transfer of the lots sold to third parties, and<br />
shall hold the Buyer exclusively liable for the payment.<br />
The participation at the auction in the name of<br />
and on behalf of third parties is subject to prior deposit,<br />
at the offices of the Auction House at least three<br />
days prior to the auction, of a legalised power of<br />
attorney and of satisfactory bank references.<br />
Art. 3 ART reserves the right to withdraw any lot. During<br />
the auction, the Auctioneer, is entitled to join and/or<br />
separate any two or more lots and to change the order<br />
of Sale. The auctioneer, at his/her sole discretion,<br />
may also withdraw lots if the bids do not reach the<br />
reserve price agreed between ART and the Seller.<br />
Art. 4 The Buyer shall pay to ART a premium equal to<br />
21% of the hammer price comprehensive of VAT.<br />
Any other fiscal charges concerning the hammer price<br />
will be anyway charged to the Buyer’s account. Apart<br />
from the above mentioned Buyer’s premium, for lots<br />
on temporary importation from non-EU countries,<br />
the Buyer, if an EU resident shall pay any other taxes<br />
due, as well as all expenses incurred for transforming<br />
the importing from temporary to permanent<br />
(the lots concerned shall be identified by the sign **).<br />
Please note that if the Seller is a VAT registered seller,<br />
the Buyer must also pay the due charges ( the lots<br />
concerned shall be identified by the sign °°).<br />
Art. 5 For the purpose of helping the Auctioneer recognise<br />
Buyers during the auction, each prospective Buyer<br />
must complete and sign a registration form including<br />
personal data and bank references. ART reserves the<br />
right to check references and to refuse undesirable<br />
persons participation at the auction. Upon filling the<br />
form ART will provide a numbered tag which must<br />
be shown to the Auctioneer in order to bid.<br />
Art. 6 ART will be entitled to execute bids on behalf of<br />
clients (written and telephone bids), making bids<br />
through the Auctioneer in competition with the<br />
other bidders attending the Sale. In the event of<br />
two identical bids, the written bid shall prevail over<br />
the oral one.
