Art. 7 Nel caso di due offerte scritte identiche, che non siano<br />
superate da offerte in sala o telefoniche, ART<br />
considererà aggiudicataria quella depositata per prima.<br />
ART si riserva il diritto di rifiutare, a suo insindacabile<br />
giudizio, offerte di acquirenti non conosciuti<br />
e/o graditi. A parziale deroga di quanto sopra ART<br />
potrà accettare dette offerte nel caso sia depositata<br />
una somma a garanzia di importo pari al valore del<br />
lotto richiesto, oltre commissioni, tasse, e spese. In<br />
ogni caso all’atto dell’aggiudicazione l’aggiudicatario<br />
comunicherà, immediatamente, le proprie complete<br />
generalità e i propri dati fiscali.<br />
Art. 8 ART agisce esclusivamente quale mandataria dei venditori<br />
declinando ogni responsabilità in ordine alla<br />
descrizione degli oggetti contenuta nei cataloghi ed in<br />
ogni altra pubblicazione illustrativa. Tutte le descrizioni<br />
dei beni devono intendersi puramente illustrative<br />
ed indicative e non potranno generare nessun affidamento<br />
di alcun tipo negli aggiudicatari. L’asta sarà<br />
preceduta da un’esposizione dei beni al fine di permettere<br />
un congruo esame degli stessi da parte degli<br />
aspiranti acquirenti, affinché quest’ultimi, sotto la loro<br />
totale e completa responsabilità, possano verificarne<br />
tutte le qualità, quali ad esempio, l’autenticità, lo<br />
stato di conservazione, il tipo, il materiale, la provenienza,<br />
dei beni posti in asta. Dopo l’aggiudicazione<br />
nessuno potrà opporre ad ART od ai venditori la<br />
mancanza di qualsiasi qualità dei beni oggetto di aggiudicazione.<br />
ART ed i propri dipendenti e/o collaboratori<br />
non rilasceranno nessuna garanzia di autenticità<br />
e/o quant’altro. Tutte le indicazioni sulla<br />
caratura ed il peso di metalli o pietre preziose, come<br />
sui relativi marchi, sono puramente indicative. ART<br />
non risponderà di eventuali errori o della falsificazione<br />
effettuata ad arte. Nonostante il possibile riferimento<br />
ad elaborati di esperti esterni alla Casa D’Arte,<br />
ART non ne garantisce né l’esattezza né<br />
l’autenticità.<br />
Art. 9 Le stime relative al prezzo base di vendita, riportate<br />
sotto la descrizione di ogni bene sul catalogo, sono<br />
da intendersi al netto di ogni onere accessorio quale,<br />
ad esempio, diritti d’asta, tasse ecc. ecc. Poiché i tempi<br />
tipografici di stampa del catalogo richiedono la determinazione<br />
dei prezzi di stima con largo anticipo<br />
esse potranno essere oggetto di mutamento, così come<br />
la descrizione del bene. Ogni e qualsiasi cambiamento<br />
sarà comunicato dal Banditore prima dell’inizio<br />
dell’asta sul singolo bene interessato.<br />
Art. 10 Il completo pagamento del prezzo di aggiudicazione,<br />
dei diritti d’asta, e di ogni altra spesa accessoria dovrà<br />
essere immediatamente effettuato alla fine dell’asta,<br />
in valuta avente corso legale nella Nazione ove si<br />
è svolta l’asta; ART potrà concedere che il pagamento<br />
sia effettuato entro cinque giorni dalla data di aggiudicazione.<br />
In caso di mancato pagamento, fermo<br />
restando il risarcimento dei maggiori danni ART potrà:<br />
a) restituire il bene al mancato venditore ed esigere<br />
il pagamento dal mancato acquirente delle commissioni<br />
perdute; b) agire per ottenere l’esecuzione<br />
coattiva dell’obbligo di acquisto; c) vendere il lotto a<br />
trattativa privata, od in aste successive, comunque in<br />
danno del mancato compratore, trattenendo a titolo<br />
di penale gli eventuali acconti versati. Nel caso il lotto<br />
rimanesse custodito da ART ciò avverrà a rischio e<br />
spese dell’aggiudicatario e del mancato venditore in<br />
solido. In ogni caso fino alla data di vendita o restituzione<br />
l’aggiudicatario dovrà corrispondere ad ART<br />
una somma, a titolo di penale, calcolata, avendo come<br />
base, l’importo di aggiudicazione maggiorato di<br />
tutte le tasse e commissioni, al tasso del 30%. Tale<br />
somma sarà dovuta a partire dal sesto giorno successivo<br />
all’aggiudicazione.<br />

Art. 7 In the event of two identical written bids, not surpassed<br />
by other telephone bids or bids during the Sale,<br />
the first bid received by ART shall take precedence.<br />
ART reserves the right to refuse bids from unidentified<br />
and/or undesirable Buyers unless Art so chooses<br />
that they pay a deposit covering the entire value of<br />
the lot requested, including commissions, charges,<br />
and expenses. Following the Sale, the Buyer must immediately<br />
provide comprehensive information regarding<br />
personal data and tax details.<br />
Art. 8 ART acts as mere agent of the Sellers and shall not be<br />
held liable for the description of the lots in the catalogues,<br />
brochures and other publications. Any description<br />
or illustration regarding the lots are purely<br />
statements of opinion and are not to be relied upon<br />
as statements of warranty. Before every auction, an<br />
exhibition of the lots shall take place in order to allow<br />
prospective buyers to examine them, and taking<br />
full responsibility, evaluate such qualitative aspects as<br />
the authenticity, the state of preservation, the type,<br />
the materials and the provenance. Following the Sale,<br />
neither ART nor the Sellers shall be liable for any defects<br />
relative to the state of preservation, nor do they<br />
or their personnel or collaborators warrant the correctness<br />
of statements concerning attribution, authenticity,<br />
provenance, weight or quality in any item. All<br />
indications regarding the carats and weight of metals<br />
or precious stones, and their trademark, are purely<br />
indicative. ART is not liable for any errors or forgery.<br />
Notwithstanding possible reference to reports from<br />
experts external to the Auction house, ART does not<br />
warrant the correctness nor the authenticity.<br />
Art. 9 The Estimates regarding the possible Sale price, printed<br />
under their description in the catalogue, are not<br />
inclusive of the Buyer’s premium, such as commissions,<br />
charges etc. Estimates are prepared well in advance<br />
of the Sale and are therefore subject to revision.<br />
The description of the lot in the catalogue could<br />
also be subject to revision and any and every variation<br />
on each single lot will be communicated by the<br />
Auctioneer before the beginning of the auction.<br />
Art. 10 Full payment of the hammer price, including Buyer’s<br />
premium , and any other expense is to be effected immediately<br />
on conclusion of the auction and in the<br />
currency legally accepted in the State in which the<br />
auction has taken place; ART may concede payment<br />
within 5 days of the date of Sale. If payment is not<br />
effected, ART reserving the right to further damages,<br />
shall be entitled to: a) return the lot to the Seller and<br />
request payment of lost commissionfrom the faulting<br />
Buyer; b) enforce the contractual purchase obligation;<br />
c) arrange a resale of the lot privately, or in subsequent<br />
auctions, and in any event withhold as penalty<br />
any amount already paid by the Buyer. Lots are<br />
stored by ART at the expense and risk of the Buyer<br />
and the Seller jointly and severally. In any event, until<br />
the date of sale or return of the lot, the Buyer shall<br />
pay ART a penalty equal to interest calculated at the<br />
rate of 30% on the hammer price plus the Buyer’s<br />
premium and all charges. The interest so calculated<br />
shall be applied on the amounts owed starting from<br />
the sixth day following the Sale.
