correspondence <strong>in</strong> friction ridge detail that is necessary for a conclusion of<br />

identity has not been established. There is an even more basic deficiency,<br />

however. There is no methodology <strong>in</strong> place that is capable of measur<strong>in</strong>g the<br />

amount of correspondence <strong>in</strong> a f<strong>in</strong>gerpr<strong>in</strong>t comparison. And there is a third,<br />

corollary deficiency: there is no methodology <strong>in</strong> place that is capable of<br />

measur<strong>in</strong>g the amount of detail that is available <strong>in</strong> a f<strong>in</strong>gerpr<strong>in</strong>t for comparison<br />

to another. In summary, one cannot:<br />

1. Measure the amount of detail <strong>in</strong> a (s<strong>in</strong>gle) f<strong>in</strong>gerpr<strong>in</strong>t that is available<br />

to compare<br />

2. Measure the amount of detail <strong>in</strong> correspondence between two f<strong>in</strong>gerpr<strong>in</strong>ts<br />

3. Objectively <strong>in</strong>terpret the mean<strong>in</strong>g of a given correspondence between<br />

two f<strong>in</strong>gerpr<strong>in</strong>ts<br />

AFIS technology, while hold<strong>in</strong>g promise <strong>in</strong> these areas, has been and<br />

rema<strong>in</strong>s restricted to the task of screen<strong>in</strong>g millions of pr<strong>in</strong>ts and efficiently<br />

select<strong>in</strong>g candidates for f<strong>in</strong>gerpr<strong>in</strong>t comparison. Although this is an important,<br />

effective and, <strong>in</strong>deed, revolutionary task, the comparison itself is<br />

reserved for the <strong>in</strong>dividual f<strong>in</strong>gerpr<strong>in</strong>t exam<strong>in</strong>er. The exam<strong>in</strong>er applies personal,<br />

subjective criteria that, despite all its historical precedent, legal acceptance,<br />

and public confidence, are both vague and flexible.<br />

Although not directly the subject of this chapter, the above deficiencies<br />

are compounded by the fact that neither the education of f<strong>in</strong>gerpr<strong>in</strong>t exam<strong>in</strong>ers,<br />

nor the process of f<strong>in</strong>gerpr<strong>in</strong>t comparison is standardized. Furthermore,<br />

there have been no objective studies provid<strong>in</strong>g validation of the<br />

subjective processes that are <strong>in</strong> place.<br />

Recognition of the above deficiencies does not mean that the f<strong>in</strong>gerpr<strong>in</strong>t<br />

practices are discredited, that they have no foundational basis, or that the process<br />

is necessarily unreliable. Given the Daubert criteria, 2 however, the question of<br />

reliability is a reasonable one to ask. Legal scrut<strong>in</strong>y of f<strong>in</strong>gerpr<strong>in</strong>ts is, after more<br />

than 80 years of uncritical public and judicial acceptance, entirely appropriate.<br />

Without objective standards, however, what foundational aspects for<br />

f<strong>in</strong>gerpr<strong>in</strong>t identification do we have?<br />

The Laws or Premises Underly<strong>in</strong>g F<strong>in</strong>gerpr<strong>in</strong>t Identifications<br />

For many years, two “laws of f<strong>in</strong>gerpr<strong>in</strong>ts” have been asserted as the foundation<br />

for f<strong>in</strong>gerpr<strong>in</strong>t identifications: 3<br />

1. F<strong>in</strong>gerpr<strong>in</strong>ts never change (apart from temporary abrasion and permanent<br />

scarr<strong>in</strong>g).<br />

2. No two f<strong>in</strong>gerpr<strong>in</strong>ts (made from different f<strong>in</strong>gers) are alike.
