SALE OF PLATE PROHIBITED IN SCOTLAND UNLESS<br />

ASSAYED AND MARKED AT EDINBURGH OR<br />

GLASGOW.<br />

A.D. 1836. 6 & 7 William IV. Entitled, "An Act to fix the<br />

standard qualities of <strong>gold</strong> and <strong>silver</strong> <strong>plate</strong> in Scotland, and to provide<br />

for the assaying and marking thereof.<br />

"Secti<strong>on</strong> 2. And be it enacted that <strong>on</strong> or before the ist day of<br />

October, 1836, every <strong>gold</strong>smith, <strong>silver</strong>smith, or <strong>plate</strong>-worker, or<br />

pers<strong>on</strong> carrying <strong>on</strong> any of the said trades in Scotland, and also every<br />

pers<strong>on</strong> who at any time after the ist day of October, 1836, shall<br />

follow the trade of <strong>gold</strong>smith, <strong>silver</strong>smith, or <strong>plate</strong>-worker before<br />

he shall exercise the same, shall send or deliver either to the Wardens<br />

of the Incorporati<strong>on</strong> of the City of Edinburgh or to the<br />

Wardens of the Glasgow Company a written statement of his<br />

Christian and surname, place of abode, etc.<br />

Secti<strong>on</strong> 3. Every such <strong>gold</strong>smith, <strong>silver</strong>smith, and platsworker,<br />

or pers<strong>on</strong> carrying <strong>on</strong> any of the said trades in Scotland,<br />

shall first stamp or strike his mark up<strong>on</strong> all <strong>gold</strong> or <strong>silver</strong> <strong>plate</strong><br />

(except such as are hereinafter excepted)* which he shall make or<br />

cause to be made after the ist October, 1836, and bring or send it<br />

to the A.ssay Office of the Incorporati<strong>on</strong> to which he shall have<br />

delivered his name and address and mark aforesaid, together with<br />

a note of the weight, quality, etc. ; and such <strong>gold</strong> <strong>plate</strong> as shall be<br />

ascertained to be not less in fineness than 22 karats of fine <strong>gold</strong> in<br />

every pound weight Troy, and such <strong>silver</strong> <strong>plate</strong> as shall be ascertained<br />

to be not less in fineness than 1 1 ounces and 2 pennyweights<br />

of fine <strong>silver</strong> in every pound weight Troy, shall be marked at such<br />

with the mark of the th'stle<br />

Assay Office as follows^ that is to say,<br />

and such a distinct variable letter, denoting the year in which such<br />

<strong>plate</strong> shall be marked, and also with the mark or <str<strong>on</strong>g>marks</str<strong>on</strong>g> used by<br />

the Incorporati<strong>on</strong> at whose Assay Office the same shall be assayed;<br />

and such <strong>gold</strong> <strong>plate</strong> as shall be ascertained to be not less in fineness<br />

than 18 karats of fine <strong>gold</strong> in every pound weight Troy shall be<br />

marked with the figures 18 in additi<strong>on</strong> to the said several <str<strong>on</strong>g>marks</str<strong>on</strong>g><br />

therein before required; and such <strong>silver</strong> <strong>plate</strong> as shall not be less<br />

in fineness than 11 oz. 10 dwts. of fine <strong>silver</strong> in every pound Troy<br />

shall be marked with the figure of Britannia in additi<strong>on</strong> to the sev-<br />

eral other <str<strong>on</strong>g>marks</str<strong>on</strong>g> hereinbefore required.''<br />

A more recent Act of 1842, 5 & 6 Vict, relating to the stamping<br />

of foreign <strong>plate</strong>, and the prohibiti<strong>on</strong> of its sale in the United Kingdom<br />

unless assayed and stamped at the appointed Assay Offices as<br />

being of the legal standard, under certain penalties, extends to<br />

Scotland.<br />

The Act of 7 & 8 Vict, 1844, "Criminal Law C<strong>on</strong>solidati<strong>on</strong>,"<br />

does not extend to Scotland or Ireland.<br />
