2. any person or entity that contracts with or is funded, licensed, certified, or regulated by a<br />

state agency or political subdivision to provide custody or care for a person under<br />

paragraph A.<br />

A residential facility is required to notify the school district in which the facility is located of<br />

the placement of a person three years of age or older. The facility is required to give the notice<br />

not later than the third day after the date of placement. A district should contact residential<br />

facilities in the district to coordinate implementation of this notice provision. In general,<br />

students placed in residential facilities are entitled to admission under other provisions of<br />

§25.001. However §25.001(b) (7) provides a uniform admissions provision for children in<br />

such facilities. Additionally, the notice requirement should generate communication between<br />

the facilities and school districts that will promote efficiency in the provision of educational<br />

services to these children.<br />

A student residing in the district is entitled to admission if the student is over 18 years of age<br />

or if the student is less than 18 years of age and has had the disabilities of minority removed<br />

through marriage or as otherwise permitted by law.<br />

The law makes special provision for children in foster care. Children in foster care are to be<br />

provided tuition-free admission in the district in which the foster parents reside. In addition,<br />

the use of a durational residence requirement to prohibit a foster child from participating in<br />

any school-sponsored activity is forbidden. A high school student placed in temporary foster<br />

care is provided the option of continuing to attend, without payment of tuition, the school in<br />

which the student was enrolled at the time of placement, regardless of the residence of the<br />

foster parents. Pre-Kindergarten students must go to the Early Childhood Department for<br />

acceptance.<br />

2.3 Pre-Kindergarten Enrollment<br />

Four-Year-Old Program – The District will offer pre-kindergarten classes if the District identifies 15 or<br />

more eligible children. To be eligible for enrollment in a four-year-old pre-kindergarten class, a child<br />

must be at least 4 years of age on or before September 1, <strong>2012</strong>. The student must also meet one of the<br />

criteria listed below:<br />

IV. The student is unable to speak and comprehend the English language. Home Language Survey<br />

indicates a language other than English is spoken in the home and the student qualifies as a<br />

Limited English Proficient (LEP) student as determined by a state-approved assessment given by<br />

the Student Placement Center (SPC) upon initial enrollment; or,<br />

V. The family income, according to standards set by the State Board of Education or other<br />

appropriate regulatory guidelines, is at or below subsistence level; that is, the student must be<br />

eligible for the National Free or Reduced Price Lunch Program. Verification of household income<br />

must be completed prior to enrollment of the student; or,<br />

VI. Appropriate pre-kindergarten staff and McKinney Project Staff determines eligibility for students<br />

who are homeless, regardless of the residence of the child, of either parent or stepparents of the<br />

child, or the child’s guardian or other person having lawful control of the child.<br />
