Elementary Schools<br />

Elementary school campuses may not serve or provide access for students to FMNV and all<br />

other forms of candy at any time anywhere on school premises until the end of the last scheduled<br />

class.<br />

The following foods are restricted in elementary campuses at all time during the entire school<br />

day: soda water, water ices, chewing gum, and certain candies such as hard candy, jellies and<br />

gums, marshmallow candies, fondant, licorice, spun candy, and candy coated popcorn. Such<br />

foods and beverages may not be sold or given away to students on school premises by school<br />

administrators or staff (principals, coaches, teachers, etc.), students or student groups, parents or<br />

parent groups, or any other person, company or organization.<br />

Note: After School Programs are considered part of the school day at least until after Child<br />

Nutrition Services (CNS) snacks are served.<br />

An elementary school campus may not serve competitive foods (or provide access to them<br />

through direct or indirect sales) to students anywhere on school premises throughout the school<br />

day until the end of the last scheduled class. This does not pertain to food items made available<br />

by the school food service department.<br />

Elementary classrooms may serve one nutritious snack per day in the morning or afternoon (not<br />

during meal periods) under the teacher’s guidance. Snacks provided must comply with the fat<br />

and sugar limits of the Texas Public School Nutrition Policy, and must be single-size servings.<br />

Snacks may not contain any FMNVs or consist of candy or dessert type items (cookies, cakes,<br />

cupcakes, pudding, ice cream or frozen desserts, etc.). For nutrition snack ideas, see TDA’s<br />

listing of ―suggestions for Nutritious Snacks,‖ available on request at www.squaremeals.org.<br />

Middle Schools<br />

Middle school campuses may not serve or provide access for students to FMNV and all other<br />

forms of candy at any time anywhere on school premises until the end of the last scheduled class.<br />

Note: After School Programs are considered part of the school day at least until after Child<br />

Nutrition Services (CNS) snacks are served.<br />

High Schools<br />

High schools may not service or provide access to FMNV any time anywhere on school premises<br />

until after the end of the last scheduled class. The following foods are restricted from access to<br />

students until after the last regularly-scheduled class and/or in areas where and After School<br />

Program is being provided: soda water, water ices, chewing gum, and certain candies such as<br />

hard candy, jellies and gums, marshmallow candies, fondant, licorice, spun candy, and candy<br />

coated popcorn. This includes any carbonated beverages.<br />
