Vending machines may be operated in approved areas in all middle and high schools as long as<br />

their operation does not interfere with the National School Lunch, Breakfast, and Snack Program<br />

and the regular school program. The following regulations shall be observed.<br />

I. Principals may contract with companies that will service the machines and collect the<br />

monies. Contracts shall conform to the minimum requirements established by the<br />

Business Financial Services office. The Chief Financial Officer must approve all<br />

exceptions. A copy of the signed contract shall be forwarded to the Chief Financial<br />

Officer.<br />

II. New contracts and contract renewals executed after March 3, 2004, must expressly<br />

prohibit the sale of sugared, carbonated beverages in containers larger than 12 ounces.<br />

The principal will authorize placement of all vending machines on the school premises in<br />

compliance with the Snack Program and regular school program. The principal must also<br />

ensure all vending machines comply with Texas Public School Nutrition Policy (TPSNP)<br />

located through www.squaremeals.org.<br />

Food and beverage items in vending machines shall not be limited to foods with a<br />

highly concentrated sugar base but shall also offer students choices of nutritious<br />

foods, such as fruit and vegetable juices, milk, nuts, seeds, cheese products, crackers,<br />

fresh fruits, and chips.<br />

All drinks, containers, and cases shall be stored away from the kitchen area. No items<br />

for vending achiness may be stored in any Child Nutrition Services storage areas.<br />

Portion size applies to chips, bakery items, cookies, cereal bars, ice cream, pastries,<br />

muffins, etc. all regulations can be printed or viewed through www.squaremeals.org.<br />

There is no limit on unflavored, non-carbonated bottle water.<br />

Middle School - Vending machines located on campus grounds must comply with<br />

TPSNP policy by being turned off or locked 30 minutes before and 30 minutes after<br />

the breakfast and lunch periods.<br />

High School - No more than 15 percent of the beverages made available through each<br />

vending machine or other service point on high school campuses are allowed to be<br />

sugared, carbonated soft drinks.<br />

High School - All carbonated vending machines need to comply with TPSNP and<br />

may not be sold or made available to students until the end of the last scheduled class.<br />

III. Revenue from vending machines on campus shall be controlled by the school principal<br />

and processed through Campus/Student Activity Account. Rules governing activity funds<br />

can be found in the Activity Fund Manual.<br />
