purport to be victim-centred, <strong>the</strong>se policies are still not followed rout<strong>in</strong>ely by prosecutors, a<br />
failure that results <strong>in</strong> those who have experienced violence cont<strong>in</strong>u<strong>in</strong>g to feel, <strong>in</strong> many cases,<br />
disenfranchised by <strong>the</strong> CJS.<br />
<strong>Women’s</strong> confidence <strong>in</strong> <strong>the</strong> CJS will only improve if all women receive an ‘enhanced service’<br />
from agencies like <strong>the</strong> police and CPS. There needs to be a stricter adherence to <strong>the</strong> Victims<br />
Code by all agencies bound by it.<br />
Recommendation:<br />
Prioritise <strong>the</strong> cont<strong>in</strong>u<strong>in</strong>g improvement of victim experiences <strong>in</strong> <strong>the</strong> crim<strong>in</strong>al justice<br />
system. In particular attention must be paid to tra<strong>in</strong><strong>in</strong>g for frontl<strong>in</strong>e professionals<br />
and for <strong>the</strong> adoption of special mechanisms to improve <strong>the</strong> support provided to<br />
women throughout <strong>the</strong> crim<strong>in</strong>al and civil law processes and <strong>in</strong>crease women’s<br />
confidence <strong>in</strong> those processes<br />
Lesbian and bisexual women and hate crime<br />
Reports of violence aga<strong>in</strong>st LB women <strong>in</strong>dicate that, like violence aga<strong>in</strong>st women <strong>in</strong><br />
heterosexual relationships, <strong>the</strong> perpetrator will often be known to <strong>the</strong> victim yet <strong>the</strong> clear-up<br />
rate, when reported to <strong>the</strong> police, is low and <strong>in</strong>consistent. 21 Only 43% of lesbian women believe<br />
that <strong>the</strong>y can be open about <strong>the</strong>ir sexual orientation <strong>in</strong> <strong>the</strong>ir local police station without fear of<br />
prejudice and discrim<strong>in</strong>ation. 22 As with o<strong>the</strong>r women, most LB women would prefer to report<br />
to a female police officer and use women-only services, but this is rarely an option as <strong>the</strong>se<br />
services do not exist. 23<br />
One barrier to report<strong>in</strong>g is <strong>the</strong> <strong>in</strong>terpretation of what constitutes a homophobic hate crime.<br />
A study <strong>in</strong> 2008 found that respondents were most likely to report physical assaults but less<br />
likely to report verbal abuse or harassment, blackmail, mugg<strong>in</strong>g, and worry<strong>in</strong>gly, also less<br />
likely to report rape or o<strong>the</strong>r sexual violence as a homophobic <strong>in</strong>cident. Just under one fifth<br />
of LB women experienc<strong>in</strong>g homophobic <strong>in</strong>cidents had reported <strong>the</strong>m to <strong>the</strong> police. This was<br />
because <strong>the</strong> police officer did not make <strong>the</strong>m feel comfortable about disclos<strong>in</strong>g <strong>the</strong> nature<br />
of <strong>the</strong> <strong>in</strong>cident, did not ask <strong>the</strong> right questions to establish that <strong>the</strong> <strong>in</strong>cident was homophobic<br />
and over half of those that did disclose <strong>the</strong> nature of <strong>the</strong> <strong>in</strong>cident felt that <strong>the</strong> police were<br />
unsupportive. 24 LB women have not felt adequately <strong>in</strong>formed about an <strong>in</strong>vestigation or provided<br />
with <strong>in</strong>formation about an appropriate support organisation and four out of ten reported cases<br />
resulted <strong>in</strong> no action be<strong>in</strong>g taken or victims not know<strong>in</strong>g if action had been taken as <strong>the</strong>re was<br />
no follow-up. 25 14% of victims of homophobic hate crimes or <strong>in</strong>cidents do not report <strong>the</strong>m to<br />
anyone because <strong>the</strong>y happen so frequently that <strong>the</strong>y do not th<strong>in</strong>k that repeatedly report<strong>in</strong>g<br />
<strong>the</strong>m is worthwhile. 26 This underreport<strong>in</strong>g has led to a lack of <strong>in</strong>formation or statistics on<br />
