critical sectors such as <strong>the</strong> cater<strong>in</strong>g, clean<strong>in</strong>g and food process<strong>in</strong>g <strong>in</strong>dustries are<br />

covered by <strong>the</strong> regulations<br />

Undocumented women<br />

General Recommendation 26 90 discusses <strong>the</strong> host country’s responsibilities to undocumented<br />

migrant women, stat<strong>in</strong>g that “regardless of <strong>the</strong> lack of immigration status… States parties have<br />

a duty to protect <strong>the</strong>ir basic human rights, <strong>in</strong>clud<strong>in</strong>g humane treatment and access to legal<br />

remedies”. Women are disproportionately subjected to abuse and sexual exploitation on <strong>the</strong>ir<br />

journey to <strong>the</strong> <strong>UK</strong> and many organisations have reported systematic abuse aga<strong>in</strong>st women<br />

migrat<strong>in</strong>g through irregular channels by immigration guards, smugglers, and o<strong>the</strong>r migrants. 91<br />

This abuse is itself traumatis<strong>in</strong>g, and should form part of <strong>the</strong> woman’s case for consideration<br />

once she is here. However, <strong>the</strong> experience of such women once arriv<strong>in</strong>g <strong>in</strong> <strong>the</strong> <strong>UK</strong> is often to be<br />

disbelieved, and <strong>the</strong>y are subjected to detention and <strong>in</strong>appropriate fast track procedures to<br />

determ<strong>in</strong>e <strong>the</strong>ir claim. 92<br />

There are also examples of extra-territorial border controls fail<strong>in</strong>g women’s protection needs. For<br />

example, <strong>in</strong> 2009, <strong>the</strong> situation fac<strong>in</strong>g undocumented migrants ga<strong>the</strong>r<strong>in</strong>g <strong>in</strong> Calais compelled <strong>the</strong><br />

British Refugee Council and France Terre d’Asile to conduct a jo<strong>in</strong>t fact-f<strong>in</strong>d<strong>in</strong>g mission to assess<br />

<strong>the</strong>ir conditions and access to protections. 93 They identified <strong>the</strong> notable lack of female <strong>in</strong>terpreters<br />

<strong>in</strong> <strong>the</strong> area around Calais where makeshift camps had been constructed, and <strong>the</strong> migrant women<br />

<strong>the</strong>y <strong>in</strong>terviewed were unable to obta<strong>in</strong> any sanitary products, violence counsell<strong>in</strong>g or antenatal<br />

care. The risk of sexual violence aga<strong>in</strong>st <strong>the</strong> women was also of grave concern. 94<br />

Gender vulnerabilities <strong>in</strong>crease <strong>the</strong> likelihood of migrant women to become undocumented, a<br />

status under which <strong>the</strong>y are greatly exposed to systematic violence, abuse and discrim<strong>in</strong>ation.<br />

The majority of undocumented women arrive to Europe with a regular, but often highly<br />

dependent migration status and become undocumented for reasons outside of <strong>the</strong>ir own<br />

control. 95 The biggest barrier fac<strong>in</strong>g undocumented women <strong>in</strong> <strong>the</strong> <strong>UK</strong> is <strong>the</strong> refusal of <strong>the</strong> State<br />

to prioritise <strong>the</strong>m as victims of violence ra<strong>the</strong>r than as immigration offenders. Their status is<br />

always at <strong>the</strong> forefront of <strong>the</strong>ir experiences. The structures exist <strong>in</strong> a way that re<strong>in</strong>forces <strong>the</strong><br />

abuse of women, leav<strong>in</strong>g women at risk of fur<strong>the</strong>r violence and destitution. 96<br />

Undocumented women are also unlikely to report be<strong>in</strong>g victims of violence or o<strong>the</strong>r crimes.<br />

For women who have irregular status and often are unable to speak English, seek<strong>in</strong>g assistance<br />
