women and <strong>in</strong>crease <strong>the</strong> obstacles <strong>the</strong>y face should <strong>the</strong>y seek to exit prostitution. 43 Offences<br />
specific to prostitution are classified as sexual offences and so rema<strong>in</strong> on a woman’s record for<br />
life and have to be disclosed <strong>in</strong> crim<strong>in</strong>al records <strong>check</strong>s prior to employment, which can prevent<br />
women from obta<strong>in</strong><strong>in</strong>g ga<strong>in</strong>ful employment, particularly <strong>in</strong> car<strong>in</strong>g professions. In addition, such<br />
diversion schemes, to be effective, rely on women engag<strong>in</strong>g consistently and effectively with<br />
<strong>the</strong> service. While it is <strong>in</strong>tended that diversion schemes are accommodat<strong>in</strong>g and flexible <strong>in</strong><br />
recognition of <strong>the</strong> chaotic lifestyles of women <strong>in</strong> prostitution, pressure on resources means that<br />
this is not always <strong>the</strong> case practice <strong>in</strong>. Missed appo<strong>in</strong>tments can result <strong>in</strong> women <strong>in</strong>curr<strong>in</strong>g f<strong>in</strong>es<br />
and/or fac<strong>in</strong>g imprisonment.<br />
Section 14 of <strong>the</strong> Polic<strong>in</strong>g and Crime Act 2009, 44 which <strong>in</strong>troduced a new offence of pay<strong>in</strong>g for<br />
<strong>the</strong> sexual services of a prostitute subjected to exploitative conduct, is a welcome, if ra<strong>the</strong>r<br />
isolated, focus on tackl<strong>in</strong>g demand. At <strong>the</strong> time of writ<strong>in</strong>g, <strong>the</strong> most up to date published figures<br />
showed that some 43 convictions have been obta<strong>in</strong>ed but police and <strong>the</strong> Crown Prosecution<br />
Service have expressed reservations about how workable this legislation is. 45 In a climate with<br />
reduced resources, it is foreseeable that <strong>the</strong>re will be a dim<strong>in</strong>ished focus on this area result<strong>in</strong>g <strong>in</strong><br />
little or no work go<strong>in</strong>g forward to address demand.<br />
The Scottish approach to prostitution is one that we would welcome across <strong>the</strong> <strong>UK</strong> <strong>in</strong> that<br />
it clearly situates prostitution as VAWG, 46 discrim<strong>in</strong>ation, <strong>in</strong><strong>equality</strong> and exploitation, and<br />
consequently encourages responses that address demand and can also support women<br />
who wish to exit. The Welsh Government has funded projects around sexual exploitation but<br />
have failed to <strong>in</strong>clude this <strong>in</strong> <strong>the</strong>ir violence aga<strong>in</strong>st women strategy, The Right to be Safe. 47 (See<br />
Annex 1)<br />
Recommendations:<br />
• Take whatever steps necessary to ensure that where possible women <strong>in</strong><br />
prostitution are not crim<strong>in</strong>alised and that prostitution related offences can be<br />
wiped from a woman’s record<br />
• Take all measures, legislative and o<strong>the</strong>r, to address <strong>the</strong> demand for women <strong>in</strong><br />
prostitution and promote support services for women <strong>in</strong> prostitution <strong>in</strong>clud<strong>in</strong>g<br />
specialist support for women wish<strong>in</strong>g to exit<br />
Legislat<strong>in</strong>g aga<strong>in</strong>st extreme pornography<br />
The <strong>in</strong>clusion of ‘legislation aga<strong>in</strong>st extreme pornography’ 48 <strong>in</strong> <strong>the</strong> Government’s report is<br />
perplex<strong>in</strong>g. There has been much criticism around <strong>the</strong> new legislation, 49 which, unlike <strong>the</strong><br />
Obscene Publications Act 1959 50 that covers distribution, crim<strong>in</strong>alises <strong>in</strong>dividuals <strong>in</strong> possession<br />
of pornography. 51 While we welcome steps to legislate aga<strong>in</strong>st VAWG, this legislation is<br />
