Recommendation:<br />
Gender issues should be ma<strong>in</strong>streamed so that <strong>the</strong>y are considered strategically <strong>in</strong><br />
all aspects of <strong>the</strong> asylum process, for example by l<strong>in</strong>k<strong>in</strong>g work on <strong>the</strong> Equality Act<br />
2010 and CEDAW, and by provid<strong>in</strong>g sufficient resources for <strong>the</strong> Gender Champion<br />
and stakeholder engagement on gender issues to ensure that this is effective and<br />
long-term. This should also <strong>in</strong>clude review<strong>in</strong>g timescales <strong>in</strong> <strong>the</strong> asylum process to<br />
ensure that <strong>the</strong>y are sufficiently flexible for women survivors of rape and sexual<br />
violence to be able to fully disclose <strong>the</strong>ir experiences <strong>in</strong> support of <strong>the</strong>ir asylum<br />
claims<br />
Implementation of <strong>the</strong> Asylum Gender Guidel<strong>in</strong>es<br />
In relation to <strong>in</strong>itial decision mak<strong>in</strong>g, <strong>the</strong> <strong>UK</strong>BA’s own gender audit has shown that <strong>the</strong>ir own<br />
comprehensive Asylum Gender Guidel<strong>in</strong>es are still not be<strong>in</strong>g implemented. 26<br />
Despite <strong>the</strong> CEDAW Committee’s Conclud<strong>in</strong>g Recommendation 48.d) 27 that <strong>the</strong> Government<br />
should ensure full implementation of <strong>the</strong> Asylum Gender Guidel<strong>in</strong>es, <strong>the</strong>re cont<strong>in</strong>ue to be no<br />
gender guidel<strong>in</strong>es <strong>in</strong> <strong>the</strong> asylum appeals system. The Tribunal refers <strong>in</strong>stead to <strong>the</strong> Practice<br />
Direction: Child, vulnerable adult and sensitive witnesses 28 which was extended to <strong>the</strong><br />
Immigration and Appeals Chamber <strong>in</strong> October 2010 but this fails to take <strong>in</strong>to account <strong>the</strong> nature<br />
of <strong>the</strong> claim for asylum. 29<br />
Recommendation:<br />
Ensure that Immigration Judges have appropriate guidance for mak<strong>in</strong>g decisions on<br />
women’s asylum cases, <strong>in</strong>clud<strong>in</strong>g those <strong>in</strong>volv<strong>in</strong>g gender-based persecution<br />
Access to <strong>the</strong> <strong>UK</strong> asylum process<br />
Currently, asylum seekers can only register a claim for asylum <strong>in</strong> Croydon, South London (except<br />
for families with children or <strong>in</strong> very exceptional circumstances) creat<strong>in</strong>g an additional barrier for<br />
vulnerable women to claim asylum. The Scottish Refugee Council sees cases of <strong>the</strong> difficulties<br />
this causes daily. 30<br />
Lesbian and bisexual women <strong>in</strong> <strong>the</strong> asylum system<br />
Despite <strong>the</strong> <strong>in</strong>troduction of <strong>the</strong> Sexual orientation and gender identity <strong>in</strong> <strong>the</strong> asylum claim<br />
policy <strong>in</strong>struction <strong>in</strong> 2010 <strong>the</strong>re is evidence that this guidance is not be<strong>in</strong>g followed. LB asylum<br />
seekers face repression and <strong>in</strong>stitutional discrim<strong>in</strong>ation <strong>in</strong> <strong>the</strong> <strong>UK</strong> and are often marg<strong>in</strong>alised<br />
with<strong>in</strong> <strong>the</strong> asylum system. Although <strong>the</strong>re has been some success <strong>in</strong> achiev<strong>in</strong>g recognition that<br />
homophobia and fear of persecution based on sexual orientation are legitimate grounds for<br />
asylum, <strong>the</strong> situation for LB asylum seekers is uncerta<strong>in</strong> 31 and many judges cont<strong>in</strong>ue to have<br />
