RESTORATION TO THE REGISTER<br />

5.95 A person who has been removed from the register can apply to be restored. In<br />

most cases where a registrant’s entry has been erased following fitness to<br />

practise proceedings, applications for restoration must be referred to a Fitness to<br />

Practise Panel or similar committee. 69<br />

5.96 In such cases, the legislation sets out a prescribed time limit before which<br />

applications for restoration cannot be made. The various time limits are set out in<br />

table 5 below.<br />

5.97 Most <strong>of</strong> the regulators have detailed rules for how restoration hearings should be<br />

conducted. These include rules governing the further investigation <strong>of</strong> cases,<br />

notification <strong>of</strong> hearings, order <strong>of</strong> proceedings, the giving <strong>of</strong> reasons for decisions,<br />

publication <strong>of</strong> decisions, powers <strong>of</strong> joinder <strong>and</strong> powers to refer to other<br />

committees. In most cases, the restoration decision can be appealed to the High<br />

Court in Engl<strong>and</strong> <strong>and</strong> Wales, in Scotl<strong>and</strong> the Court <strong>of</strong> Session <strong>and</strong> the High Court<br />

in Northern Irel<strong>and</strong>. 70<br />

5.98 A different procedure applies to applications for restoration in cases not related to<br />

fitness to practise proceedings, such as where the person has been removed<br />

from the register because they have been working abroad, taken a career break,<br />
