The Texas Public Utility Regulatory Act of 1999 included in the list of customer rights<br />

and safeguards that “A customer is entitled to have access… to on-site distributed<br />

generation…” and in October 1999 the Public Utility Commission of Texas adopted<br />

Substantive Rules addressing technical and procedural aspects of interconnecting<br />

distributed generation. <strong>Fuel</strong> cells are an eligible distributed generation technology.<br />

Distributed generation is limited to 10 MW at the point of interconnection, and the utility<br />

distribution system to which the distributed generation is interconnected is at a voltage of<br />

less than 60 kV. The total capacity of a facility's individual on-site distributed generation<br />

units may exceed 10 MW; however, no more than 10 MW of a facility's capacity may be<br />

interconnected at the point of common coupling.<br />
