MASSACHUSETTS<br />

The RPS, created by Massachusetts electricity utility restructuring legislation, specifies<br />

that 1% of electricity be generated from renewable sources in 2003, with the percentage<br />

increasing by 0.5% per year thereafter through 2009. Thereafter, the annual percentage<br />

increase is 1% per year, until suspended by the Division of Energy Resources. <strong>Fuel</strong><br />

cells using an Eligible New Renewable <strong>Fuel</strong> (hydrogen used in fuel cells must be derived<br />

from an Eligible Biomass <strong>Fuel</strong> or eligibly-generated electricity) comply with the RPS.<br />

The Massachusetts Department of Telecommunications and Energy (DTE) is the<br />

implementing body for electric utility regulation in Massachusetts. The DTE opened an<br />

investigation into distributed generation in 2002 and established the Massachusetts<br />

Distributed Generation Collaborative as a stakeholder group to develop uniform<br />

interconnection standards for the state. Order 02-38-B, released in February 2004,<br />

established interim interconnection standards that are used by each utility in<br />

Massachusetts. <strong>Fuel</strong> cells are eligible for interconnection.<br />
