California Assembly Bill 2628, signed into law in 2004, allows single-occupant use of<br />
HOV lanes by the cleanest alternative fuel, hybrid, and full-electric vehicles. Use of these<br />
lanes with only one occupant requires an identification sticker issued by the California<br />
Department of Motor Vehicles. Not all hybrid vehicles meet the requirements of AB<br />
2628. Eligible automotive makes and models are listed on the California Air Resources<br />
Board’s web site. The following fuel cell vehicles, operating on hydrogen, were listed as<br />
eligible for the program as of early 2006:<br />
• 2003 and 2004 Honda FCX<br />
• 2003 through 2006 Toyota FCHV.<br />
Additionally, in the nine-county Oakland/San Jose/San Francisco Bay Area, owners of<br />
qualifying hybrids will also have to prove that they own a "FasTrak" pass and<br />
transponder for their vehicle, which allows them to drive by toll booths without having to<br />
stop and pay--a process that adds to air emissions and pollution.<br />

Motor Vehicle License Fee Incremental Costs Exemption<br />

California Revenue and Taxation Code exempts from the determination of market value<br />
the incremental costs of new light-duty motor vehicles propelled by alternative fuels.<br />
The vehicle must be certified by the California Air Resources Board as producing<br />
emissions that meet the emission standard for ULEVs or lower. This exemption applies<br />
to the subsequent payments of the vehicle license fee. "Incremental cost" means the<br />
