This slide presents how CP and polluti<strong>on</strong> preventi<strong>on</strong> can be incorporated into<br />

<strong>the</strong> permitting process, enforcement acti<strong>on</strong>s and decisi<strong>on</strong>s <strong>on</strong> providing<br />

financial support to companies. The key message is that <strong>the</strong>re already exist<br />

proven ways to make CP an integral part <strong>of</strong> regulatory mechanisms.<br />

Background<br />

<strong>Cleaner</strong> producti<strong>on</strong> has traditi<strong>on</strong>ally been c<strong>on</strong>sidered a voluntary initiative, left to companies to adopt<br />

if <strong>the</strong>y c<strong>on</strong>sider it appropriate. In c<strong>on</strong>trast, obtaining envir<strong>on</strong>mental permitting and complying with <strong>the</strong><br />

regulati<strong>on</strong>s are obligati<strong>on</strong>s that have to be met. However, enforcing regulati<strong>on</strong>s and complying with<br />

prescriptive laws are both costly to all parties involved.<br />

C<strong>on</strong>sequently a number <strong>of</strong> countries have decided to make CP (or polluti<strong>on</strong> preventi<strong>on</strong>/source<br />

reducti<strong>on</strong>) an integral part <strong>of</strong> <strong>the</strong> permitting process. Some <strong>of</strong> <strong>the</strong> strategies that have been used to<br />

promote CP and preventi<strong>on</strong> in <strong>the</strong> permitting process include pre-permitting interviews and<br />

distributi<strong>on</strong> <strong>of</strong> informati<strong>on</strong>, permit avoidance through CP, polluti<strong>on</strong> preventi<strong>on</strong> planning, or explicit<br />

polluti<strong>on</strong> preventi<strong>on</strong> permit c<strong>on</strong>diti<strong>on</strong>s.<br />

CP in <strong>the</strong> permitting process<br />

As part <strong>of</strong> permitting, firms may be required to undergo <strong>Cleaner</strong> Producti<strong>on</strong> audits <strong>of</strong> <strong>the</strong>ir plants and<br />

to implement suggesti<strong>on</strong>s. In most cases, however, a CP review is a part <strong>of</strong> <strong>the</strong> process, and normally<br />

not an obligati<strong>on</strong> to implement all potential measures identified. The following list c<strong>on</strong>tains possible<br />

approaches:<br />

(a) Permit applicati<strong>on</strong> form includes questi<strong>on</strong>s that would help <strong>the</strong> authorities determine if CP<br />

potential exists in <strong>the</strong> applicant’s facility;<br />

(b) Permit applicati<strong>on</strong> package includes a brochure <strong>on</strong> <strong>the</strong> benefits <strong>of</strong> CP and c<strong>on</strong>tact informati<strong>on</strong> <strong>of</strong><br />

a CP technical assistance <strong>of</strong>fice;<br />

(c) A permit can be issued stipulating that a CP programme must be developed in <strong>the</strong> first year <strong>of</strong><br />

operati<strong>on</strong>, or even prescribe that companies must dem<strong>on</strong>strate that <strong>the</strong>y have a waste<br />

minimizati<strong>on</strong> plan in place at <strong>the</strong> beginning <strong>of</strong> operati<strong>on</strong>s. Typically, companies are <strong>the</strong>n required<br />

to submit annual progress reports;<br />

(d) Reduced record-keeping, inspecti<strong>on</strong>s or permit fees are applied to companies that implement a<br />

CP programme;<br />

(e) Envir<strong>on</strong>mental fees and charges are set to encourage implementati<strong>on</strong> <strong>of</strong> preventive techniques;<br />

(f) Some permits issued are based <strong>on</strong> an integrated analysis <strong>of</strong> processes ra<strong>the</strong>r than <strong>on</strong><br />

envir<strong>on</strong>mental media specific impacts.<br />
