judges to resolve competing claims <strong>of</strong> values and institutional<br />

responses to emergencies without much textual guidance. On the<br />

other hand, a common problem across jurisdictions that resonates<br />

in the Sri Lankan experience has been the tendency <strong>of</strong> judges to<br />

defer to the executive in times <strong>of</strong> emergency, resulting sometimes<br />

in the vitiation <strong>of</strong> the model as one <strong>of</strong> legal accommodation and<br />

appropriate balance between emergency powers and the<br />

protection <strong>of</strong> democratic values, especially fundamental rights.<br />

2.2
The
‘Business
as
Usual’
Model<br />

This model, which has its provenance in a particular juridical<br />

debate framed by a peculiarity <strong>of</strong> the constitution <strong>of</strong> the United<br />

<strong>States</strong>, disallows a departure from the normal legal system under<br />

any circumstances. It embodies theories <strong>of</strong> constitutional<br />

absolutism and constitutional perfection. Constitutional<br />

absolutism involves unconditional commitment to the<br />

constitutional instrument as a <strong>for</strong>tress <strong>of</strong> rights which is<br />

exempliLied by the notions that whatever measures a government<br />

may take, they cannot under any circumstances diminish or<br />

suspend constitutionally protected rights, and further, that<br />

government may not lawfully purport to exercise any special<br />

powers in an emergency that are not explicitly conferred on it by<br />

the constitution. Constitutional perfection denotes the idea that<br />

the constitution reLlects a Lixed and unchanging balance between<br />

liberty and governmental powers, which equilibrium cannot be<br />

altered.<br />

There<strong>for</strong>e, the constitution, perfect and complete, anticipates<br />

every exigency and provides within its framework all the powers<br />

as are necessary <strong>for</strong> government to face any contingency. This<br />

model is different from the interpretive accommodation model<br />
