THE CASE FOR CHANGE<br />

7.69 We consider that Magistrate Members <strong>of</strong> <strong>the</strong> Authority, as well as o<strong>the</strong>r<br />

Members with experience <strong>of</strong> <strong>the</strong> legal system, would be particularly adept at<br />

scrutinising <strong>the</strong>se cases as <strong>the</strong>y will have experience <strong>of</strong> case management in <strong>the</strong><br />

courts.<br />

7.70 Scrutiny by <strong>the</strong> MPA should continue on a monthly basis until <strong>the</strong> matter is<br />

concluded.<br />

7.71 We consider that it would be appropriate <strong>for</strong> <strong>the</strong> IPCC to examine evidence<br />

and investigative procedures in those cases at six-monthly intervals. We are<br />

uncertain as to whe<strong>the</strong>r <strong>the</strong> IPCC’s existing powers can be construed as including a<br />

power to monitor in this way. If <strong>the</strong>y cannot, we consider that an express power<br />

should be conferred by regulations.<br />

7.72 Where <strong>the</strong> <strong>of</strong>ficer is suspended, that case should be deemed to be an<br />

Accelerated Procedure <strong>Case</strong> from <strong>the</strong> time <strong>of</strong> suspension. This would mean that<br />

resources (including <strong>of</strong>ficer time) will automatically be allocated to <strong>the</strong> case to<br />

ensure rapid progress in <strong>the</strong> investigation and to minimise <strong>the</strong> duration <strong>of</strong> <strong>the</strong><br />

<strong>of</strong>ficer’s suspension.<br />

7.73 In cases involving suspension, <strong>the</strong> internal case management function should<br />

be undertaken outside DPS at Assistant Commissioner level on a monthly basis.<br />

<strong>The</strong> Assistant Commissioner will adopt a case conference approach, give guidance<br />

on <strong>the</strong> management <strong>of</strong> <strong>the</strong> case and agree <strong>the</strong> continuation <strong>of</strong> <strong>the</strong> <strong>of</strong>ficer’s<br />

suspension or alternatively restore him or her to duty.<br />
