e necessary in order to stabilize the road base. Pursuant to Section 210 <strong>of</strong> the 408<br />

Specifications, Intercounty was required to excavate unstable material encountered in the<br />

subgrade. Removal <strong>of</strong> the unsuitable material, as directed, was within the definition <strong>of</strong> Class 1<br />

Excavation in Section 203 <strong>of</strong> the 408 Specifications. The Contract contained no warranty that<br />

unsuitable material would not be encountered in the subgrade but, in fact, contemplated there<br />

could be and provided a payment mechanism to address this possibility. In fact, it contained no<br />

representations at all regarding the quantity <strong>of</strong> undercut that would be required or, to our<br />

knowledge, the general type or types <strong>of</strong> subsurface material to be encountered. Intercounty has<br />

failed to establish that there were undisclosed site conditions or that the extent <strong>of</strong> unsuitable<br />

material encountered was so excessive or different from its normal cut and fill work as to<br />

constitute a "differing site condition" under Section 110.02 <strong>of</strong> the Specifications. See, Angelo<br />

Iafrate Construction Co., Inc. v. Pennsylvania Turnpike Commission, No. 3654, 2006 WL<br />

2585020 at *59-63 (Pa. Bd. <strong>Claims</strong>, July 27, 2006).<br />

As to Intercounty’s claim that it was not paid at the proper rate for the undercutting, the<br />

<strong>Board</strong> finds PennDOT does owe some additional compensation to Intercounty for a small<br />

fraction <strong>of</strong> this work. There is no dispute that Intercounty has been paid for its undercutting<br />

work at the Class 1 Excavation rate <strong>of</strong> $9 per cubic yard for all the undercutting performed. The<br />

parties also appear to agree that there were approximately 11,115 cubic yards <strong>of</strong> undercut on the<br />

Project. Intercounty, however, claims that it should be paid for all this undercutting as non-Class<br />

1 Excavation at the approximate cost to it <strong>of</strong> $34 per cubic yard.<br />

The evidence presented establishes that the bulk <strong>of</strong> the undercut work performed on the<br />

Project involved the removal <strong>of</strong> unsuitable material by cuts into the roadway subgrade <strong>of</strong> 8 feet<br />

in width or greater. Pursuant to Section 203.1(a) <strong>of</strong> the applicable 408 Specifications, Class 1<br />
