Excavation is defined to include: "[e]xcavation, as indicated or directed, for the removal <strong>of</strong><br />

unsuitable material having a bottom width <strong>of</strong> 2.5 m (8 feet) or more." Moreover, Intercounty has<br />

failed to persuade the <strong>Board</strong> that "undercutting" unstable roadway subgrade that is 8 feet wide or<br />

more is inherently any more difficult than performing original cut and fill work <strong>of</strong> like width.<br />

Thus, we find that the bulk <strong>of</strong> the undercutting performed on the Project was Class 1 Excavation<br />

and that Intercounty has been properly paid for this work at its bid rate <strong>of</strong> $9 per cubic yard.<br />

However, the evidence presented also showed that Intercounty was directed to perform<br />

undercutting that had a width <strong>of</strong> less than eight feet for approximately 470 cubic yards <strong>of</strong> the<br />

total. This 470 cubic yards <strong>of</strong> excavation work is most appropriately defined as Class 1A<br />

Excavation under Section 203.1(b) <strong>of</strong> the Specifications and constitutes "extra work," is defined<br />

by Section 110.03(c) <strong>of</strong> the Specifications as "work, having no quantity and/or price included in<br />

the contract, which is determined by the District Engineer to be necessary or desirable to<br />

complete the project."<br />

Intercounty has adequately established that its actual cost for this type <strong>of</strong> excavation<br />

(undercuts <strong>of</strong> less than 8 feet bottom width) is fairly estimated at $34 per cubic yard. Therefore,<br />

Intercounty is entitled to be paid at that rate for the 470 cubic yards <strong>of</strong> undercut with a bottom<br />

width less than 8 feet. At $34 per cubic yard, this totals $15,980. However, the amount<br />

Intercounty was already paid for the work by PennDOT must be deducted (470 cubic yards x $9<br />

= $4,230). Accordingly, we find that Intercounty has incurred additional costs <strong>of</strong> $11,750 for the<br />

undercutting performed on the Project. With appropriate markup, this results in $13,571.25 in<br />

damages due to Intercounty for this work.<br />

Intercounty also makes a claim for disruption damages in connection with its overall<br />

undercutting operations. The <strong>Board</strong> understands that Intercounty had to move equipment and<br />
