. A recording secretary is to be appointed by the committee moderator.Verbatim transcripts <strong>of</strong> the proceedings may be made at the request andexpense <strong>of</strong> any party.c. All issues in dispute shall be orally presented by the committee moderator.d. The complainant will first present all information supporting the chargesmade against the student.e. Following this presentation, the student who is under investigation willpresent his/her side <strong>of</strong> this issue, submitting for committee study allinformation which he/she chooses to submit.f. At the completion <strong>of</strong> all discussion, the complainant and the student mayeach make a summary statement.g. At any time during the hearing, the complainant, the student, the committeeand/or college representatives may raise questions about the informationunder review so that all aspects <strong>of</strong> the case are clarified.h. Silence by the charged student shall not be interpreted as an admission <strong>of</strong>guilt.11. The committee shall reach a decision using the following guidelines:a. The hearing committee will meet in closed session to reach a decision. Suchmeeting must be held within one school day following the formal hearing.b. If the hearing committee seeks additional information followingcommencement <strong>of</strong> its deliberations, it will notify the parties within twoschool days and reconvene the hearing within five school days <strong>of</strong> theconclusion <strong>of</strong> the original hearing. The hearing committee‟s final decisionmust be made within seven school days <strong>of</strong> the conclusion <strong>of</strong> the originalhearing.c. A decision to find the student guilty <strong>of</strong> the accusations will need at least threeaffirmative votes. The moderator may not vote in case <strong>of</strong> a tie.d. The committee decision will be presented in writing to the Associate Dean <strong>of</strong>Student Services who then will inform the applicable Dean. The committeedecision must be based solely on the evidence presented at the hearing andmust include all recommendations for final disposition <strong>of</strong> the issues involved.Any penalties must conform to Section on Sanctions <strong>of</strong> the Code <strong>of</strong>Responsibilities and Rights <strong>of</strong> the Students <strong>of</strong> <strong>Touro</strong> <strong>University</strong>.<strong>2011</strong> – <strong>2012</strong> COM Student Handbook
