e. The applicable Dean, after reviewing the decision <strong>of</strong> the hearing committee,has the authority to affirm, negate, and/or modify the decision. Theapplicable Dean shall then notify the student who allegedly violatedacceptable student conduct <strong>of</strong> the committee decision and the Dean‟sdecision and shall inform the student <strong>of</strong> his/her right to appeal the decision.f. The university will institute the recommended disciplinary action <strong>of</strong> theapplicable Dean unless some pertinent factor such as legal ramificationprecludes such action or the student involved appeals the decision.12. An appeal may be instituted by the following methods:a. The student may request an appeal to the President within five school days <strong>of</strong>notification <strong>of</strong> the committee‟s decision.b. At the time <strong>of</strong> request for appeal, the student must submit in writing to thePresident the basis for the appeal. All facts necessary to substantiate theappeal must be included within the request for appeal.13. The President will act upon the appeal bya. confirming the Dean‟s decision,b. modifying the decision, orc. ordering a new hearing.14. The decision <strong>of</strong> the President is final.15. Records <strong>of</strong> the above proceedings shall be kept in accordance with the followingguidelines:a. If the committee finds no merit in the allegation under discussion, all records<strong>of</strong> the proceedings shall be sealed and secured in the <strong>of</strong>fice <strong>of</strong> the AssociateDean <strong>of</strong> Student Services until such time as any legal statute <strong>of</strong> limitations hasexpired. Upon such event, all records <strong>of</strong> the proceedings shall be destroyed.Should a need arise to open the sealed records, the <strong>University</strong> President shallbe notified. At the applicable college Dean‟s, CEO‟s, or President‟s discretion,an order to open the record shall be issued by him/her. These records willnot go into a student‟s personal disciplinary file.b. If the committee finds merit in the allegations against a student, a full record<strong>of</strong> the proceedings and all relevant materials shall be entered exclusively inthe student‟s personal disciplinary file located in the <strong>of</strong>fice <strong>of</strong> the AssociateDean <strong>of</strong> Student Services.<strong>2011</strong> – <strong>2012</strong> COM Student Handbook
