Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 3 Offences against the administration of law and justice, against office and againstpublic authorityChapter 16 Offences relating to the administration of justice[s 123](a) attempts by threats or intimidation of any kind, or bybenefits or promises of benefit of any kind, or by othercorrupt means, to influence any person, whether aparticular person or not, in the person’s conduct as ajuror in any judicial proceeding, whether the person hasbeen sworn as a juror or not; or(b) accepts any benefit or promise of benefit on account ofanything to be done by the person as a juror in anyjudicial proceeding, whether the person has been swornas a juror or not, or on account of anything already doneby the person as a juror in any judicial proceeding;is guilty of a crime.Maximum penalty—7 years imprisonment.123 Perjury(1) Any person who in any judicial proceeding, or for the purposeof instituting any judicial proceeding, knowingly gives falsetestimony touching any matter which is material to anyquestion then depending in that proceeding, or intended to beraised in that proceeding, is guilty of a crime, which is calledperjury.(2) It is immaterial whether the testimony is given on oath orunder any other sanction authorised by law.(3) The forms and ceremonies used in administering the oath or inotherwise binding the person giving the testimony to speakthe truth are immaterial, if the person assents to the forms andceremonies actually used.(4) It is immaterial whether the false testimony is given orally orin writing.(5) It is immaterial whether the court or tribunal is properlyconstituted, or is held in the proper place, or not, if it actuallyacts as a court or tribunal in the proceeding in which thetestimony is given.Current as at 1 December 2014 Page 103
