Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 8 ProcedureChapter 67 Appeal—pardon[s 671K]prescribed, subject to such power as may be prescribed for theconditional release of any such documents, exhibits, or otherthings from that custody.671K Recording of trial proceedings(1) The Recording of Evidence <strong>Act</strong> 1962, section 5 provides forrecording the proceedings at a trial of a person on indictment.(2) On any notice of appeal or application for leave to appeal, arecord of the proceedings or any part thereof shall, if directedby the registrar, be furnished to the registrar for the use of theCourt or any judge thereof.(3) A copy of a record of proceedings or of any part thereof maybe furnished to any party interested in accordance withprovisions of the <strong>Criminal</strong> Practice Rules 1999 and the<strong>Criminal</strong> Practice Rules 1999, without limiting the generalityof the foregoing, may prescribe, in respect of a trial or inrespect of an appeal or in respect of both a trial and anappeal—(a) charges for the copy of the record or part thereof; or(b) circumstances in which such charges may be varied orwaived and on whose or by what authority they may bevaried or waived; or(c) who is a ‘party interested’ for the purpose of havingfurnished to the person a copy of the record or partthereof; or(d) the authorisation of the furnishing of a copy of a recordof proceedings or of any part thereof to any other personon the ground that such person has a sufficient interesttherein, and by whom any such authorisation may bemade.(4) In addition to the foregoing, the Attorney-General may causea copy of a record of proceedings or of any part thereof to befurnished to any person in such circumstances and subject tosuch conditions as the Attorney-General thinks fit.Current as at 1 December 2014 Page 443
