Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 6 Offences relating to property and contractsChapter 44A Special provisions in respect of offences relating to stock[s 450I]magistrate is satisfied that the commission of the offence bythat person was facilitated by the holding by the person of adriver licence or by the use by the person of a motor vehicle,the court or magistrate may order and direct in addition to anysentence that may be passed or penalty that may be imposedthat the offender shall, from the date of conviction, bedisqualified absolutely from holding or obtaining a driverlicence to operate a motor vehicle or be so disqualified forsuch period as the court or magistrate shall specify in theorder.(2) A copy of the order shall be transmitted to the chief executiveof the department in which the Transport Operations (RoadUse Management) <strong>Act</strong> 1995 is administered by the officer orclerk having custody of the records of the court wherein theconviction was recorded.(3) In this section—driver licence includes any driving licence or driving permitdeemed to be equivalent in <strong>Queensland</strong> to and accepted in lieuof a driver licence for the purpose of authorising the holderthereof to drive in <strong>Queensland</strong> any vehicle of the type or classto the driving of which the driving licence or driving permit isapplicable.(4) Nothing contained in this section limits the operation of anyother provision of any <strong>Act</strong> under which the court or magistrateis empowered to do any act or thing in respect of the driving,or the driver licence, of any offender.450IForfeiture in cases of conviction for offences underspecified sections(1) Where a person is convicted of an offence under section 242,398 (where the offence relates to the stealing of an animal),444A, 444B, 445, 446, 447, 448, 448A or 468, the court ormagistrate may order to be forfeited to Her Majesty anyvehicle, vessel, animal, equipment or other property or thingused in connection with or to facilitate the commission of theoffence of which the person has been convicted.Current as at 1 December 2014 Page 291
