Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 8 ProcedureChapter 67 Appeal—pardon[s 671E]an appeal, the appellant shall not be entitled to be present,except by leave of the Court.(2) The power of the Court to pass any sentence may be exercisednotwithstanding that the appellant is not present.671E Appeals permitted in writingAn appellant shall be entitled to present the appellant’s caseand argument to the Court in writing if the appellant sodesires.671FCosts of appeal(1) On the hearing or determination of an appeal, or anyproceedings preliminary or incidental thereto, no costs shallbe allowed on either side.(2) The expenses of any assessor appointed, and of any witnessesattending on the order of the Court or examined, and of andincidental to any examination or reference, and of theappearance of an appellant on the hearing of the appeal or onany proceedings preliminary or incidental to the appeal, shallbe defrayed out of the Consolidated Fund up to an amountallowed by the registrar; but, subject to any regulations as torates of payment made by the Crown Law Officer, thedecision of the registrar may be reviewed by the Court or ajudge thereof.671G Grant of bail to appellant and custody when attendingCourt(1) An appellant who is not granted bail shall, pending thedetermination of the appeal, be treated in such manner as maybe directed under the laws relating to prisons.(2) The period the appellant is in custody pending thedetermination of the appeal counts as part of any term ofimprisonment under the appellant’s sentence.Page 440 Current as at 1 December 2014
