Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 8 ProcedureChapter 62 Trial—adjournment—pleas— practice[s 617](2) In this section—counsel includes any person entitled to audience as anadvocate.617 Presence of accused(1) Subject to this section the trial must take place in the presenceof the accused person.(2) If an accused person so conducts himself or herself as torender the continuance of the proceedings in the person’spresence impracticable, the court may order the person to beremoved and may direct the trial to proceed in the person’sabsence.(3) Where 2 or more accused persons are charged in the 1indictment, if it is made to appear to the court that any of themis unable to be present by reason of the person’s illness orinfirmity, the court may permit the person to be absent duringthe whole or any part of the trial if it is satisfied—(a) that the interests of the accused person will not beprejudiced by the trial proceeding in the person’sabsence; and(b) that the interests of justice require that the trial shouldproceed in the person’s absence.(4) The court may in any case permit a person charged with amisdemeanour to be absent during the whole or any part of thetrial on such conditions as it thinks fit.(5) If an accused person absents himself or herself during the trialwithout leave, the court may direct a warrant to be issued toarrest the person and bring the person before the courtforthwith.617A JuriesThe law respecting the qualifications of jurors and thesummoning of jurors to attend for the trial of persons chargedPage 410 Current as at 1 December 2014
