Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 8 ProcedureChapter 59 Jurisdiction—preliminary proceedings—bail[s 557]557 Place of trial(1) A person charged with committing an offence may be tried inany jurisdiction within which any act or omission or eventwhich is an element of the offence takes place.(2) A person charged with stealing any property may also be triedin any jurisdiction within which the person has the stolenproperty in the person’s possession.(3) A person charged with stealing anything while employed inthe public service may also be tried in any jurisdiction withinwhich the person is arrested or is in custody.(4) A person charged with an offence which involves thereceiving of any property by the person may also be tried inany jurisdiction within which the person has the property inthe person’s possession.(5) A person charged with forging anything, or with uttering anyfalse document or writing or anything counterfeit, may also betried in any jurisdiction within which the person is arrested oris in custody.(6) A person who is charged with counselling or procuring thecommission of an offence, or with becoming an accessoryafter the fact to an offence, may also be tried in anyjurisdiction within which the principal offender might betried.(7) A person who is charged with an offence committed out of<strong>Queensland</strong>, and who may lawfully be tried in <strong>Queensland</strong>,may be tried in any jurisdiction within which the person isarrested or is in custody.(8) If a person is charged with committing an offence for whichthe person may lawfully be tried in <strong>Queensland</strong> and it isuncertain where the offence was committed, the person maybe tried in any jurisdiction within which the person is arrestedor is in custody.(9) A person charged with committing an offence can be triedwith the person’s consent in any jurisdiction.Current as at 1 December 2014 Page 335
