Schedule 1 The Criminal CodePart 7 Preparation to commit offences—conspiracy— accessories after the factChapter 55 Attempts and preparation to commit offences[s 535]Part 7Chapter 55Preparation to commitoffences—conspiracy—accessories after the factAttempts and preparation tocommit offences535 Attempts to commit indictable offences(1) If a person attempts to commit a crime, the person commits acrime.(2) If a person attempts to commit a misdemeanour, the personcommits a misdemeanour.536 Punishment of attempts to commit indictable offences(1) A person who attempts to commit an indictable offencepunishable by mandatory life imprisonment is liable, if noother punishment is provided, to life imprisonment.(2) A person who attempts to commit an indictable offencepunishable by life imprisonment but not mandatory lifeimprisonment is liable, if no other punishment is provided, to14 years imprisonment.(3) A person who attempts to commit any other indictable offenceis liable, if no other punishment is provided, to a punishmentequal to one-half of the greatest punishment to which anoffender convicted of the offence is liable.(4) In this section—mandatory life imprisonment means a penalty of lifeimprisonment that can not be mitigated or varied under thisCode or any other law.Page 312 Current as at 1 December 2014
Schedule 1 The Criminal CodePart 7 Preparation to commit offences—conspiracy— accessories after the factChapter 55 Attempts and preparation to commit offences538 Reduction of punishment[s 538](1) When a person is convicted of attempting to commit anoffence, if it is proved that the person desisted of the person’sown motion from the further prosecution of the person’sintention, without its fulfilment being prevented bycircumstances independent of the person’s will, the person isliable to one-half only of the punishment to which the personwould otherwise be liable.(2) If the punishment to which the person would otherwise beliable for the attempt is imprisonment for life, the greatestpunishment to which the person is liable is imprisonment for14 years.539 Attempts to procure commission of criminal acts(1) Any person who attempts to procure another—(a) to do an act or make an omission in Queensland; or(b) to do an act or make an omission outside Queensland;being an act or omission of such a nature that, if the act weredone or the omission made, an offence would thereby becommitted—(c) in the case referred to in paragraph (a)—under the lawsof Queensland; or(d) in the case referred to in paragraph (b)—under the lawsin force in the place where the act or omission isproposed to be done or made;whether by himself, herself or by the other person, is guilty ofan offence of the same kind and is liable to the samepunishment as if the person had attempted to do the same actor make the same omission in Queensland.(1A) However, in the case referred to in subsection (1)(b), thepunishment can not exceed that which the person would haveincurred under the laws in force where the act or omission wasproposed to be done or made, if the person had attempted todo the proposed act or make the proposed omission.Current as at 1 December 2014 Page 313
