Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 7 Preparation to commit offences—conspiracy— accessories after the factChapter 55 Attempts and preparation to commit offences[s 535]Part 7Chapter 55Preparation to commitoffences—conspiracy—accessories after the factAttempts and preparation tocommit offences535 Attempts to commit indictable offences(1) If a person attempts to commit a crime, the person commits acrime.(2) If a person attempts to commit a misdemeanour, the personcommits a misdemeanour.536 Punishment of attempts to commit indictable offences(1) A person who attempts to commit an indictable offencepunishable by mandatory life imprisonment is liable, if noother punishment is provided, to life imprisonment.(2) A person who attempts to commit an indictable offencepunishable by life imprisonment but not mandatory lifeimprisonment is liable, if no other punishment is provided, to14 years imprisonment.(3) A person who attempts to commit any other indictable offenceis liable, if no other punishment is provided, to a punishmentequal to one-half of the greatest punishment to which anoffender convicted of the offence is liable.(4) In this section—mandatory life imprisonment means a penalty of lifeimprisonment that can not be mitigated or varied under this<strong>Code</strong> or any other law.Page 312 Current as at 1 December 2014
