Schedule 1 The <strong>Criminal</strong> <strong>Code</strong>Part 3 Offences against the administration of law and justice, against office and againstpublic authorityChapter 12 Unlawfully obtaining or disclosing information[s 86](3) In this section—criminal organisation informant means any of thefollowing—(a) anyone who has given, to the police service or anexternal agency, information that the commissionerreasonably believes is criminal intelligence for thepurposes of the <strong>Criminal</strong> Organisation <strong>Act</strong> 2009, andwho is not a police officer or officer of the externalagency;(b) an authorised officer who has obtained information inrelation to the activities of a criminal organisation whileacting under the Police Powers and Responsibilities <strong>Act</strong>2000, chapter 12;(c) a police officer who has obtained information throughthe use of an assumed identity, whether or not under thePolice Powers and Responsibilities <strong>Act</strong> 2000, chapter12;(d) an informant under the <strong>Criminal</strong> Organisation <strong>Act</strong> 2009,schedule 2, definition informant, paragraph (d).external agency see the <strong>Criminal</strong> Organisation <strong>Act</strong> 2009,section 59A.information, about the identity of a criminal organisationinformant, includes information that is likely to lead to theidentity of the informant becoming known.secret information, in the possession of a law enforcementagency or law enforcement officer, means information it is theduty of the agency or officer to keep secret.Current as at 1 December 2014 Page 79
